Visa type for non married but together as couple and 1 child in common

I had found an some old posts from 2011 and before where DCF seemed to be an option in Costa Rica.  Anyway, @Jonajimz, you could ask in the DCF subforum how DCF works and if you might be eligible.  If not, the best way would be the CR-1 route.  Read the CR-1 guide and then ask in the CR-1 subforum if you need help with that. 

DCF could be done through any embassy prior to ~2012 or so

I don't think a fiance (k1) visa would be a good route for you.  If he is the only one who works, then no one will be supporting your family once you move to the USA.  He would not be able to work without his EAD and currently that takes about 6 months to get.  CR1 would be your best option.

Thank you very much... my sister and her husband live in Ocala Fl,they are willing to help but I don't know if that would be something useful tho...

My fiancee is an owner operator truck driver here in Costa Rica,the plan is to go to FL and get his CDL and start driving as soon as possible...

He was in U.S on 2006 and 2007(we weren't together at that time,I was 14yrs old and living here with my mom)with a H2B and H2R Visa and came back at the time he suppose to come and paid taxes and all legal stuff required back then but seems like nothing is really helpful...

But thank you and everyone for all the info and the advise...

I think CR1 is going to be the route...

Do you know if we can do that (get the CR1) by ourselves or we suppose to get an attorney?

We had some issues with attorneys a while back...

Provided there are no overstay issues from your husband, and all of his previous work and stays in the USA were legal, It shouldn't be too much of an issue.  If you may have need of a waiver, you can always acquire an attorney at that point in time (which happens after interview.)

Thank you! I'm not used to all that paperwork and legal stuff besides my daughter's... but we'll find the way
