Visa type for non married but together as couple and 1 child in common

Hi everyone I'm new here

 

I'll try to keep it as short as I it could be.

I've been living in Costa Rica since 2000 I'm American Citizen,I have 2 daughters which the youngest is from my actual couple.

We've been together for almost 6 years,he is the provider to our home,he is Costarrican,he didn't get the tourist Visa despite he had all the paperwork (hacienda,car title,house mortgage paperwork,etc)

How can we do all the process to move to U.S,being him the only one who works and provides for our home?

What could be the fastest way to proceed?

Thanks if someone knows which way to go...

We've been together for almost 6 years without marrying because we thought it was (in some way) better for the process...

I believe the only options available would be a fiance visa or spousal visa, but both would come with different challenges because of your situation. And of course for either one, you'd need to be willing to marry (soon, for the spousal visa, or down the road for the fiance visa).

 

Since you do not work, you would need a sponsor for the Affidavit of Support and I believe there is also the need to prove U.S. domicile, but I'd need other members to chime in about that as I don't know the specifics.

 

Also need to consider the expenses associated with immigration (it is not cheap, no matter what you decide to do), where you would live, how would you pay for your life here, etc.

Timeline

Are you planning on marrying?  If so, then the CR1 spousal visa would be the path, but more than likely you will need to find a US cosponsor.  If not planning on marrying, then a visitor visa is the only visa, but it is for visiting only.  If you don’t want to get married, but you do want to live in the US, there is no option from a family visa standpoint.

 

A fiancé visa is another option if you are planning on marrying, but the CR1 is superior as it would allow him to start working almost upon arrival.

@ All the experts: Can you still do DCF in Costa Rica?

 

Other things to consider: 

 

You will most likely need a sponsor in the U.S. with sufficient income and/or property. 

 

You will also probably also need a written permit from your first daugher's father that agrees to her moving to the U.S. with you. 

 

And lastly, if you haven't done so already, see if you can get U.S. passports for your daughters.   You might need a Consular Report of Birth Abroad (CRBA) for each of them.

The petitioner is always the sponsor.  No way around that.  It is possible for an eligible person to be a co-sponsor.

Well thanks for the quick response everyone.

My children already have their U.S passports.

The father of the oldest agree with the deal.

I know it'll be expensive anyway but we want to do this.

We tried the fiancee before (lost 3k) and we suspended the process when my younger daughter was born...

I appreciate all the comments and all the help... 

If we decide to apply for the CR1 I'll let u know how it goes...

I had found an some old posts from 2011 and before where DCF seemed to be an option in Costa Rica.  Anyway, @Jonajimz, you could ask in the DCF subforum how DCF works and if you might be eligible.  If not, the best way would be the CR-1 route.  Read the CR-1 guide and then ask in the CR-1 subforum if you need help with that.

It was an option most everywhere until they changed policy

It wasn't a denial.

We didn't want to continue the process because the new born...

We lost the $3k because that was the amount we pay until then to the attorney and fees...

Actually the attorney passed away last month so we tried tourist Visa then...

Today he got the denial for that one...

Oh, sorry to hear.  Btw, most likely you can do this without an attorney.  Most of us here have done so!

Yeah thanks,we're going to do it by ourselves this time...

We've spent enough in the past but we won't give up...

My father was Sargent and served for almost 50 years but they didn't care about it...

I live here since he passed away and that's why I'm not in U.S 

I came here with my mom when I was ten,she is tica and didn't want to live there without my father so I grew up here...

My two sisters are living in U.S since then in and my brother is serving at the army at this time...
