Thank you for the informations 

My friend has a question,  he is a U.S citizen  he and his wife both live abroad. 

They are only married for 3 months now.

How long they should be married before applying to his wife ? And which form.

Thanks for posting this thread. It's really helpful. I just have a question regarding I 129f 

I filed I 130 and I want to file k3. In the current version. Of the i 129f form in part 1 page 4 question 43 asks 

If you've ever filed I 129F for any other beneficiary before? 

 

I had initially filed I 129 f for k1 visa for my fiance who is now my husband back in 2017, it was approved then it was sent back at embassy level. So we got married and now going through the cr1 route. 

How am I suppose to answer that question? Since it's for the same person

You answer yes.   That is what happened.

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

They are married so there is only one option.   File a I-130 based petition.   Follow the guides.

 

Have your friends set up a free account here on Visa Journey.

 

If they live on a country with an USCIS International Field Office they can petition Directly (lookup DCF)

For those curious why K-3 individuals don't require Advance Parole like K-1 individuals, see 8 C.F.R. §245.2(a)(4)(ii)(C): "The travel outside of the United States by an applicant for adjustment of status, who is not under exclusion, deportation, or removal proceeding and who is in lawful K-3 or K-4 status shall not be deemed an abandonment of the application if, upon returning to this country, the alien is in possession of a valid K-3 or K-4 visa and remains eligible for K-3 or K-4 status." The K-3 is valid for multiple entries during it's 2 year validity period.

Hey the name of fb group is I130 and I129f K3 spousal visa all service centers. 

February 13 2015: Started dating (met in New Orleans)

February 13 2018: Married in New Orleans

March 29 2019: PD for 1-130 (Spouse) - Nebraska Service Center

May 20 2019 : PD for 129F (K3 spouse visa)

June 21 2019 : I129F denial

June 22 2019 : I130 APPROVAL (only 85 days after submission) 😀 

July 17 2019 : sent to NVC by NSC

September 03 2019 : received case number (72 days after approval - it was a long 10 weeks waiting time  😶)

September 06 2019 : payed fees 

September 11 2019 : uploaded documents (Financial & civil) + submit DS-260

October 17 2019 : documents reviewed by NVC - one document missing / others approved (first review after 35 days / 5 weeks)

October 21 2019 : missing document submitted (police certificate from another country I lived in - this country is requiring 2 different police certificates and I only had one...stupid mistake)

November 22 2019 Documentary Qualified email :D 

December 10 2019 Medical done 

December 16 2019 Interview Letter

January 22 2020 Interview - APPROVED 😍

January 28 2020 Visa on hand 

February 25th 2020 Travel day

Our timeline is very similar to yours - about week ahead on both forms 

I have a PD on my I-129f. Separate Receipt numbers also even though they are both in Nebraska. Our I-130 has been in Nebraska since May and I filed the I-129f in early Oct. Only recieved NOA letters on both and nothing else so far.

it is the same for me... applied 130 near the end of july and i129 in the first week of aug and only received noa for both letters so far

Yes of course. He is free to visit you as much as you want

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!
