Hi. I am new to this forum. As u can see, I am applying for marriage based AOS and EAD and I came here on B2 visa. My AOS interview is in last week of July.

I have few questions:

1. Are the marriage licence and certificate are same? I got "wedding bonding" aesthetic hard cover like paper from the county office when we applied for marriage licence. If this is not certificate we have to apply for one now. Plz clarify.

2.Many people suggest and even the AOS interview letter asks us to bring the bank documents, joint lease and stuff. But I dint get my EAD yet and in this town I can not open a Bank account till I have my SSN which in turn depends on EAD. We don have any other papers to show "joint things". Only 5 months from wedding and not ready with these insurance and stuff.

3.What are my chances me being on B2 visa (my first visit to US and married in less than 40 days of arrival) to be approved for AOS!

4.What documents shall I work on to prove that I came here only to visit and my purpose is not fraud and misrep? I had my return ticket but cancelled that recently after sending it to India as I would get refund. Any other documnets shall I have to work on..

I hope some one out there in a similar situation knows hows it to go through this kind of situation. Plz give me ur valuable suggestions.

2007-Mar, 20: Recieved NOA for all the three applications

2007-Apr : Biometrics for 485 and 765 given

2007-May : Recieved Interview letter for AOS, 485

2007-Jun 02 : EAD recieved by postal mail

2007-Jun 04: Applied for SSN card

2007-Jun 23: Recieved SSN card.

2007-Jul : AOS interview at Memphis

2007-Jul 24 AOS APPROVED and recieved following emails and touches..

Card Production ordered email

Approval notice sent email

Welcome notice sent email..

... yeah all good things on same day!!

2007 Jul 30 email received "Approval Notice for I 485 sent"

2007 Aug 03 PERMANENT RESIDENT CARD RECEIVED by mail

2009 April 24 Next Form to be files I 751.. Till then No USCIS!!

1 NO, License is just permission to marry, Certificate proves that you ARE married, typically the certificate is issued by a government office like court house, clerks, health department, town hall... "Wedding Bonding" sounds like a Cert to me.

2 They are less concerned about joint things for the initial AOS interview, it is understood that you wont have many things set up jointly yet, this is more critical when you lift conditions on the 2 year conditional green-card, 2 years from now.

3 Fair, they can and do ask pointed questions to determine if the B2 visa was used with the intent of marriage and immigration, this is a misuse of the B2 visa, this is why there is a K1 visa.

4 Perhaps if you were here on a tour, the tour itinerary would be useful.

Most of your questions have been answered, I'll just add my 2 cents.

2. Bring whatever you can. You will inevitable accumulate some joint stuff, it just happens :) Things like Costco or gym membership are good if you feel you can't get jpint insurance or bank accounts in time.

3. Don't know, but people get approved left and right when they adjust from a B2 visa. Did you know your spouse before you came here? If not, I'd say you have a lot less to worry about.

Try to go with some good pictures of your relationship, some tickets to concerts, parks or any other place that show that you came as a tourist but you meet your wife or husband several times in your tourist status before decide to get married... but is a good thing to read the guidlines to see how to show that you have a bonafide marriage.

1. Get your certified marriage statement from your local court house archive.

2. As I read topics about interview, they are very interested in financial part, more then in photos sometimes. Take everything you can with you.

3.,4., Can only guess. But if you got so far already to interview, your chances are good. If there would be seriously questionable things, you would get never ending RFEs, and your case wouldn't go so far already to interview.

As far as the bank account is concerned, I (USC) was able to open an account and add my husband (UKC) who doesn't have a social security number to make it a joint account (this was at Bank of America). They only required the main account holder to have a ssn, and when they added him, they just took down his passport number instead.

October 2005: Met online playing World of Warcraft

December 19, 2005: David flies to America on VWP to visit

February 26, 2006: Married!

March 14, 2006: Filed I-130 ... by itself. Oops.

June 21, 2006: I-130 approved

March 12, 2007: Mailed I-485 package

April 5, 2007: Biometrics

May 30, 2007: Email notification: EAD approved!!

June 4, 2007: EAD received!!

July 24, 2007: Interview 8am APPROVED!!! Day 133 from filing. Emails for card production and welcome letter.

July 25, 2007: Passport stamped

August 6, 2007: GC in hand

Thank you all for your valuable suggestions. You guys rock with ur knowledge on immigration. Seriously u guys are better than lawyers.

I know my wife before I came to US, since she is one of my relative. Infact, I came here to attend her sisters wedding and ended up marrying this gal. It seems pretty fantasy but its true and it happens in indian culture.

I had resistance from my family earlier that they wanted me to come back to India to get married there, but we convinced them the difficulties and we consulted a lawyer here and he suggested us that we can go ahead and get married but the risk would be there since I came here on B2. We decided to take this risk since we dont want to be aprt for months and years waiting for the different immigration forms to arrive and to get approval when I go back to India.

The good news is I GOT MY EAD TODAY...
