I can't say anything.... too many warning already about voicing opinions lol

That is sad and hopefully this is not an opinion but an observation. We seem to see many posts here the original question focuses on an issue of little importance, but raises something that does matter and then crickets.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I was thinking the exact same thing as well. The big issue I would worry about right now is who is paying for the medical treatment and how that is perceived?

If any of her medical expenses were covered by federal public programs like Medicare or Medicaid, it could be a problem.  If it is a state-funded program or county hospital she might be okay.  It all depends.  Either way there may be public charge concerns with the AOS application given her medical condition.  If the OP or the mom funded 100% of the medical costs themselves then their income and/or assets are huge so an officer would be less likely to have a public charge concern.  Let's hope the OP posts an update.  Public charge issues have been more strictly enforced in recent months.

She certainly would not have been covered by Medicare, does not qualify.

Having had this in my own Family past, fortunately not in the US, most unlikely this is not an ongoing situation. Somebody I knew was in remission but the drug costs were $3,000 a month and was under the impression it could be a lot more than that.

That's quite cheap.  Some of the bone marrow growth factor shots I give are $3k per injection.

Hopefully the OP will come back and explain what is happening.

I have been a certified oncology RN for 19 years.  Self-funded cancer treatment of the nature mentioned  (surgery, chemo, radiation) in the OP would cost hundreds of thousands of dollars.

Easily.

~$4600 for biosimilars (filgrastim-based), much more with branded drugs.

There are coupon programs for them to cover much of the cost, but the OP's mother would not qualify.

Just curious about the process. Say the AOS is denied due to the risk of the applicant of being a public charge, will a deportation notice quickly follow? It seems that if a deportation notice doesn't follow then the OP would likely ignore the fact that her mother is out of status as she has done for the last 2 years, and there wouldn't likely be much consequence as... 1) she lives with her daughter, 2) doesn't seem to need to work, and 3) doesn't seem to need other benefits that legal status would confer to her.

A denied AOS would put her in the system, currently she is a visitor who never went home and they would not have an address etc for her.

She obviously has medical issues and as long as they can pay for her ongoing costs I guess that is possible. Unclear how she has been treated, some things you can get treated on an Emergency basis, but there is a lot which would not be catered for.

So I am in the middle of my Mom's green card application. We got the approval of her petition 2 months ago and now I am in the process of filing for her green card. I am not sure which address I am going to put since she is currently living with me. Please read below.

1. I am a US Citizen

2. She arrived in the US in February 2017 and never left since then. She was supposed to go home in August but then we found out she has breast cancer so we decided to just let her stay here. She has medical records of all of her radiation/chemo sessions and even her surgery from then until now. So please no bashing about her overstaying here :)

3. I filed her application in January of this year and I stated there that her physical address is here in the US.

Now, I am filing up the application for her green card and I am not sure if I should put her address here in the US 9cause she is here physically) or our home address in the Philippines?

Thanks in advance.

If you have to "get a lawyer ASAP," it's never simple.

I thought overstay was forgiven only for spouses of USCs?

The law regarding AOS for direct family members seems quite broad, but it is what it is.

https://www.uscis.gov/tools/glossary?topic_id=i#alpha-listing:

Quote

Immediate relatives include:

  • The spouses of U.S. citizens,
  • The children (unmarried and under 21 years of age) of U.S. citizens,
  • The parents of U.S. citizens at least 21 years old, and
  • Widows or widowers of U.S. citizens if the U.S. citizen filed a petition before his or her death or if the widow(er) files a petition within 2 years of the citizen’s death.

Above is the INA definition of immediate relative.

Let me get this straight:

https://www.fairus.org/issue/illegal-immigration/law-against-hiring-or-harboring-illegal-aliens

You harbored and assisted an illegal while you were an LPR (which is a felony) then swore during naturalization that you have abided by all the laws of the United States while you were an LPR, which qualified you for citizenship, obtained citizenship, then think you are going to sponsor the illegal you were harboring?

You do need a lawyer.  Pretty sure you won’t pull this one off.

To clarify; are you referring to the Good Moral Character requirement? https://www.uscis.gov/policy-manual/volume-12-part-f-chapter-5

I assumed they meant this from the N-400:

Quote

Have you EVER committed, assisted in committing, or attempted to commit, a crime or offense for which you were NOT arrested?
