Non-Immigrant visa affidavit of support

Recommended Posts

  1. As others noted, the affidavit of support was not a consideration in them getting the visa or not. See https://travel.state.gov/content/travel/en/us-visas/tourism-visit/visitor.html, which clearly states this.
  2. The I-134 is not enforceable. this has been upheld consistently in court and is noted in official text from USCIS.
  3. Just as a note in case you deal with this in the future, an enforceable affidavit of support (I-864) - for an immigrant visa or AOS -  cannot be pulled just because you don't want to sponsor someone anymore. Always understand the forms you sign to determine your responsibilities and if/when they terminate. You're fortunate to find out now that the one you provided has no backing, but this is something you need to research more closely before doing so in the future.

in honesty back before i even did an application,  i sent one for my friends in Ecuador to visit me  (2007) and it was accepted

with a letter of invitation as they stayed with me

their son had been an exchange student and stayed with my parents

seems South America at that time did accept / not sure it works even there now

but that may be why the myth continues as i have seen when i travel that many residents of 3rd world countries do not ask a government source "what to do" and "what are the rules"

afraid to say but many Americans do the same / ask here instead of look up USCIS instuctions or even go to the guides above

they ask someone / so if it ever worked in the past,   they assume will work now

How do you know it worked in the past?

So what about all the people who were not refused visa's who did not submit an I 134?

i have no data on that to go by

the only real sites i can actually believe are the USCIS stats  

and this is not one they would be concerned with

DOS would be the one with stats on this, not USCIS, since it deals with visas.

This is what is meant by correlation does not imply causation. Your experience does not mean it is the norm. There also may be people who got approved that wore mix-matched socks the day they got approved. It does not mean they got approved because of them wearing mix-matched socks.
