Confused about RFE Request...

I received an RFE and I read the first page and initially thought that they wanted me to submit translations for any documentation that was in another language.  The second page indicates that I failed to answer a question regarding my criminal history.  Answering that question is easy....NO!  My question is is there template language on the RFE that reads, "If you submit a document in any language other than English, the document must be accompanied by a full and complete English Translation.  The translator must certify that the translation is accurate and he or she is competent to translate from that language to English.  If you submit a foreign language translation in response to this request for evidence, you must also include a copy of the foreign language document."  Is this language that is sent on each form or are they asking me to get documentation (divorce decree and text messages submitted in Spanish) translated as well as answering my criminal history question. 

 

Also, there is a section on the RFE that asks Yes___ or No____ in regards to the criminal history, do I answer it on the form or resend the application with that question answered?

A formal statement in which a translator shows that they have accurately translated a foreign-language document into English. Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's certification that they are competent to translate the foreign language into English.

I received literally this exact same RFE for our I-129F.  I checked 'No' in the area provided on the second page of the RFE, signed and printed my name where indicated, and returned it.  We were approved after that, no problem.

 

The language in the first page is a form letter they send with all RFEs, the second page is specific to your case.

I thought that might be the case, but I couldn’t find a new RFE letter sample online like that.  I’m going to put that in the mail ASAP!  Thank you so much!!

Did you submit any information in another language when you first applied?  I sent text messages and a divorce decree in Spanish.  That’s why I was wondering if I need to respond with those translated.

If the Divorce Decree was sent in Spanish without a certified English translation, it will need to be updated at some point along the process. I believe the instructions are very clear that any document that is not in English must have a certified translation.

 

Now, if they are not asking about it in this RFE, I wouldn't go sending them documents they have not yet asked for. However, I would be proactive in getting all translations done now, so when they ultimately ask for it you have it available without delay.

 

Also, just a general note, but make sure you read all of the information within the instruction packets. Critical reading is essential in this process. This information regarding translations is 100% within the instruction packages, so if you've missed it then likely you haven't been taking a critical read through documents.

 

I don't mean for this to come off as chastising you, only that this process is long and tedious. Even in the best case scenarios it can be exhausting. Getting RFEs and having uncecessary delays because you did not provide information contained within the instructions only makes the process more difficult. My suggestions are to double and triple check all instructions and documents that you are submitting every step of the way. You can also use VJ forums, which are great resources and a great community. Being vigilant about the process will ensure you have a successful result and prevent you from unecessary delays.
