I've answered questions on the forms to include both my child and my mom as suggested.  

 

I've collected all the information needed, employment letter, bank letter, w-2, 1040, IRS transcripts for the past 3 years etc, together with completed 134 form.

 

a couple more questions for the support affadavit:

1.  As i understand, i don't have to file a seperate 134 form for my fiancee's minor child since we've included the child as K-2, is that correct?

 

2.    is it ok to send the scanned copies of support affadvit to my fiancee in china to bring for the interview?  or i need to fedex the actual paper documents to her to bring for interview?

@erdosnew  Did you have interview today?   If so were there any issues with additional documents?

yes, we had interview at U.S. consulate in Guangzhou earlier today  -  my fiancee received her k1 visa!  😃

 

the interviewing consul accepted our documents with no issue, he asked a few questions - on how we met, whether we visited each other, etc. straighforward questions, no issues.  Total length from entering consulate gate to receiving visa is an hour and half.

This is taken directly from the instructions to the form posted on USCIS website.

 

You don't want to follow them then be my guest, but the instructions specifically do not state that the child must be a dependent. Moderators, can we close this thread please? All questions have been answered. No further responses are necessary.

 

lol lets just ignore that 'unless you did not claim them as a dependents on your FEDERAL income tax returns.

Yes, YOU DID.  There is an 'AND' between 'age of majority' AND 'you did not claim them as dependents on your Federal...."

 

You claim them on the 1040, they are dependents.  What is a dependent?  Someone who has lived with you for more than 6 months of the year, you provide more than 50% of their living expenses.

The directions clearly state “you may exclude if they are above the age of majority AND you did not claim them as dependent.” That means you need to meet BOTH criteria. Learn how the English language works.

If you claim them on your taxes, they are a dependent.  You cannot claim a rando off the street, you have to SUPPORT THEM.  Even in the US, at 18 they are an adult and cannot be claimed unless they are in school or disabled.  This is all tax law.

I get that you're confused.

JFC you’re dull. Read the instructions again. It says to list the number of children you have. You can exclude only IF they are adults AND you do not claim as a dependent.

 

Nowhere does it say you can exclude a minor child who you don’t claim. Learn how to comprehend English.

Looks like my case is ready and I am waiting for Xiu to get her P3 packet sometime next week.

 

I already have tickets for 14 days in the beginning of Sept so she'll have a month to get her paperwork done.  

 

Did you get the medical done in Guangzhou?  It seems that you can do the medical and interview in the same week is scheduling works out.   Is that what you did?

we had the medical done in Shanghai, since it's closer to where my fiancce is in eastern China.  She picked up the results in 4 days and brought it with her to the interview.
