Not out of status. He will be in authorized stay once he receives his NOA1 until a decision is made on his application

The person I was replying to said ONE YEAR.  I was questioning HIS statement

YMMV

K-1 visa will be cancelled upon entry. Right after entry, you'll have 90 days to marry -as per I-94 form-.

You DO NOT need an I-693 if your fiancé's vaccinations were completed overseas. If they weren't, wait to complete them until you have an interview date for AOS. In any case, include DS-3025 in the AOS packet.

File for AOS before his I-94 expires.

Get his SSN, and state ID if possible. Add him to your insurance.

For more details, check the guides.

So it looks like I was missing a few steps here between his arrival and getting married 😅

  1. Apply for SSN asap
  2. He completed his vaccinations in Japan, so it looks like we won't need an I-693.
  3. Apply for marriage license
  4. Get married
  5. Apply for AOS and EAD/AP at the same time after getting married, before I-94 expires (90 days upon his arrival)
  6. AOS interview

So once he receives the EAD/AP, can he start working legally?  How long does it typically take to be approved?

Thanks everyone!

Current processing times are being reported at 3.5 to 5.5 months for EAD.   This number has been changing a bit lately

YMMV

For a more thorough schema of required actions and associated timing, see the VJ K! Flow Chart, https://www.visajourney.com/content/k1flow/. The actual timelines may be off, but the sequence is good.

So once he receives the EAD/AP, can he start working legally? Once he receives his EAD he can start working.   How long does it typically take to be approved?

At the present time, EAD/AP processing is taking anywhere from six to ten months, hopefully that will change for the better. For a gauge of how long AOS processing takes,, review some of the monthly threads in the K1/K3 AOS Progress forum. The current VJ stats are showing that it is taking more or less about a year for AOS adjudication. You should also check USCIS figures for AOS processing.  Those figures are highly variable, depending on the number of applications, the present workload at the service centers, the workload shifting by USCIS to the various service centers and the local field offices.......

Thanks everyone!

If you haven't already, you should likely check into the marriage laws in your local municipality/state, they all have different regulations. For example, some have a waiting period between marriage license purchase and when you can actually use the license. If you can, try to purchase multiple copies of your official certified marriage certificate, you can always find a use for them.

Good luck on your immigration journey.

Thanks for everyone's responses!  I actually called our city hall today to ask about a marriage license appointment, and they said if my fiance is coming on a K1 visa, he doesn't need an SSN to get married, just the visa.  Did anyone else find this to be the case as well?

Yes indeed the SSN is not needed to get to get married but it is Highly recommended to get it within a few days after the immigrant's arrival because it helps to open a bank account, establish credit, be added to bills, Health insurance etc. All these help to make your fiance's new life easier and you can start having proof of a bona fide marriage.

If he tries to get it after the marriage they will most likely refuse and he will have to wait until he gets his work permit.

Thanks for everyone's responses!  My fiance arrived on Friday, and we tried to go to the Social Security Office in our town on Monday, but they said we had to wait 15 business days from the date of his arrival before we could file for his social security number.  Can we get around this by going to a different office location?

It's worth a try if another one isn't too far out of the way (or even try again at the same place and hope you get a different person).

There's no law or regulation requiring a 15 business day wait to apply for an SSN for a K-1 recipient as far as I know (there's some guides suggesting waiting two weeks before applying, but these are mostly older and I think out of date), and I do know my wife (then my fiancee) was able to file to get her SSN two days after POE in downtown San Diego in March and didn't have any problems with it (save for her card getting kind of stuck in the mail for a few days).

Hmmm...  We waited until after the wedding to get the Social Security Card in order to avoid the name-change hassle (she took my name).  Your fiancé will not have the same issue, but I don't think there's any problem waiting until after the wedding...
