My fiancé just got his K1 Visa approved, and now we're looking at next steps for his arrival.  I know we have to fill out the I-693 for vaccinations, and the I-864 and I-485 for AOS - do these all have to be completed by his Visa expiration date, or within the 90 day period that we have to get married after he arrives?  His visa expires at the end of November, and he's going to come at the beginning of October.  We're planning to get married within a week or so of his arrival, but I'm not sure that we'll have enough time to finish all of the other documents by his visa expiration date if that's the deadline.  Also, are there any other major steps that I'm missing here?  Thank you!

Take a look at the guides section at the top of the page on a computer. There are very good step by step guides on what needs to be done.

After arrival the visa expiration date is meaningless.   You need to pay attention to the 90 day clock

His expiration day only mean time he has to enter usa, once he enter usa his visa is over, k1 is only one entrance.

Example if he flight today to usa his visa is over, it isnt good nomore.

Then you need get marry before 90 days after he enter usa.

There isnt a timeline to fill out i-485, but now the tgings are diferent with immigration and after 90 days ge will be out of status, so it is better fill out i-485 before 90 are over.

If he did  medical exam and vacines at his home country he doesnt need new medical exam.

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

Civil surgeon is required to transcribe the DS-3025 to the I-693.

 

Visa expired upon entry (clearing POE).    Legal status in the USA is governed by the I-94, which is only valid for 90 days.

 

There is not an actual deadline for filing the I-485, but once the I-94 validity has expired so has legal status  ;)    Once you file for AOS legal status is then good for a year.

Has the rules changed regarding to the i-693 and DS-3025? Is the i-693 always required these days even if you have a complete overseas DS-3025?

But only if you don't qualify for the "K" visa exception per the I693 instructions

K visa has an exception if the complete ds3025 was included in the sealed envelope per the i693 instructions

So are you saying that AOS applicants are out of status for those that are experiencing 18+ months to get their interview?

K-1 visa will be cancelled upon entry. Right after entry, you'll have 90 days to marry -as per I-94 form-.

You DO NOT need an I-693 if your fiancé's vaccinations were completed overseas. If they weren't, wait to complete them until you have an interview date for AOS. In any case, include DS-3025 in the AOS packet.

File for AOS before his I-94 expires.

Get his SSN, and state ID if possible. Add him to your insurance.

Suggest that you also consider applying for EAD/AP (I-765/I-131) concurrently with AOS (I-485). If concurrently filed, there are no additional fees for EAD/AP. See Special Instructions on USCIS I-485 link for more details: https://www.uscis.gov/i-485 . Many people mistakenly think that they will not need EAD or AP, only to find out during the prolonged waiting times for AOS that they should have applied for EAD/AP. There is generally one posting per week about folks lamenting not concurrently filing for EAD/AP with AOS.

 

Br sure to look at the VJ sample forms for tips on filling out the forms.

Not out of status. He will be in authorized stay once he receives his NOA1 until a decision is made on his application
