Hi has anyone been denied because of US spouse and children also US citizens receive or have had in the past received Government assistance like food stamps and medicaid ive been hearing this is happening I601A gets approved and at the interview it gets denied

Have you been living with your spouse during the time period of your family receiving government assistance? Are they continuing to receive government assistance? If so, these might be facts that the IO uses in making a decision on your case. I don't know enough about immigration law, much less the laws governing waivers to say for sure, though.

yes we got married and i was already receiving food stamps and medicaid i had asked our lawyer before starting and he said it wont affect it since hes not receiving the assistance but just read a case where it did happen

It does sound like immigration is getting tougher on many issues that applicants face, but if your attorney is advising you that you're okay, then I wouldn't worry too much. Here's an old comprehensive thread on the public charge issue...

 

By the way, even though I'm claiming ignorance, I am aware of the case of a local friend. She's been married to her USC husband for 15 years. They have two children, USC's also, and the children have been on Medicaid for many years. She, however, has never accepted any government assistance. The couple finally took the immigration steps of getting her legal status and they too had an i601a waiver approved. She went to Juarez for her interview about a year ago and everything went smoothly and she was approved. Best of luck to you and your husband.

It has come up where the USC and children were on benefits and the Joint Sponsor was weak.

  There was an old case from Nigeria where the USC had been on government aide forever and they denied based on the fact he was likely to follow her footsteps .  I think he didn't even have a high school education. 

This will not be over quickly. You will not enjoy this.

i hope its not my case my husband will be registering his company as soon as he gets everything approved and wont be needing anything but only medicaid but only the kids he pays his own medical insurance
