Criminal Checks on Beneficiary

I have gotten mixed answers from various sources, so I hope I can get an affirmative response here.  My fiance is a Mexican national and we are currently living in San Carlos, Sonora, Mexico.  Her K-1 Visa interview is scheduled for October 7 at Juarez.  I know that she has to have a criminal check from the Mexican authorities, but I read also that is she was over 16, and resided in the USA for over 6 months (she was there for 4 years, left almost 10 years ago returning to Mexico) a criminal check from the US is required.  I thought that the fingerprints she will give at the ACS in Hermosillo would be used for the US criminal checks?  Can anyone tell me for sure if I need to somehow get a criminal check for her from the US and how to go about doing that.  Thank you.

It will be done automagically for her time in the USA

If she was charged with any felonies you will need a certified copy from the court giving the final disposition of the charge.  If she wasn't charged with anything than you don't have to worry about it.  My husband had traffic tickets and they didn't ask for anything regarding that.  But he did have a burglary charge and I had to get a certified copy from the superior court stating the final disposition on that charge.  Even if she got arrested and there were no charges filed you don't have to get anything for that.

Nothing need for the US.   She does need a Police Clearance from the Polica Estado in Hermosillo.

Make sure you take proof of your domicile in the US with you to her interview.   I got called in for my wife's interview and they had questions about my domicile.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
