Hi everyone!

I just wanna ask how a current individual annual income (line 18 of the I-864EZ form) is calculated if the sponsor is currently in the military?

Should my hubby use or calculate just his monthly basic pay by multiplying it by 12? Or should he include his other/extra pays in the calculation like for example housing allowance, sea pay etc.?

pls help!

June 5, 2006 - Received by USCIS

June 20,2006 - I130 notice date

January 25, 2007 - Hubby became a naturalized citizen

January 26, 2007 - sent mail to upgrade from F2 to IR1 and also upgraded it over the fone (USCIS told him to wait for 45 days for I130 to be upgraded)

March 13-Received a letter from USCIS asking for a copy of naturalization cert plus a cover letter entitled I130 Request for Upgrade

March 20- faxed the papers

March 21- TOUCHED!!! finally after 9 months...

March 22- Approval notice

April 2 - Case received by NVC and was assigned a case #.

April 30 - DS3032 & AOS Fee Bill have been generated and sent out

May 2 - NVC accepted agent of of choice w/c was e-mailed the same day DS-3032 was generated

May 7 - IV Fee bill has been generated

May 15 - Both AOS and IV fee bills received in the mail.

May 16 - Mailed both bills to NVC via USPS (overnight)...

May 25 - NVC finished processing AOS fee payment.

May 28 - I-864 package was generated and mailed out

May 29 - NVC finished processing IV fee payment

June 4 - DS230 was generated

June 8 - I-864 package was received in the mail

June 13 - sent I864EZ to NVC

June 15 - DS230 received in the mail

June 20 - DS230 sent to NVC

June 25 - DS230 received by NVC...I864EZ completed

July 6 - CASE COMPLETE!

Aug 15 - INTERVIEW DATE! Approved!!!

Oct 2- it's time to leave...= ) = (

I'm really not sure.... I'd suggest you call base legal and ask them. Sorry I can't be of more help!

5 August 2006 - Married in Iowa

September 2006 - Military paperwork filed

5 June 2007 - I130 sent

29 June 2007 - NOA1

05 July 2007 - NOA2

07 July 2007 - touched

23 July 2007 - NVC assigns case no

25 July 2007 - Choice of agent form recieved and sent

23 August 2007 - IV bill (says it was generated August 6th but only just recieved it.....)

4 November 2007 - I-864 recieved and sent back. Message says DS-230 has been sent (grrr to postal strike!)

15 November 2007 - DS-230 finally recieved!

11 Jan 2008 - Interview letter recieved from embassy

06 Feb 2008 - Inverview and medical - paperwork incomplete

For military member's the required income level is 100% of the poverty level.

Can free housing be counted as income?

Yes. Sponsors who receive housing and other benefits in place of salary may count those benefits as income. The sponsor may count income that is not subject to taxation (such as housing allowance), as well as taxable income. The sponsor would have to prove the nature and amount of any income that is not included as wages or salary or other taxable income. Evidence of such income can be shown through notations on the W-2 Form (such as Box 13 for military allowances), Form 1099 or other documents that show the claimed income.

The BAH is issued every month for 12 but sea and seperation pay aren't and therefore might not be counted. I'd still check to be sure.

This is crazy!

current annual income is exactly what it says .....current......take the monthly amount multiply it by 12 and there you'll have your answer. If his base pay isnt enough then add the housing allowance.

My hubby does nit want to hear me out...he is ready to mail the package to NVC...I think I better let him do what he thinks is right and learn from his own mistake...it's so sickening...I've been talking like crazy and still he did not listen to me....
