I wasn’t joking.  There was recent talk of summarily denying incomplete petitions.  No RFE, no chance to fix it.  So yes, I for one am glad they sent you an RFE and didn’t make you start over.

yeah i heard that, i am glad that they didn't ask me to start over. its already been fours i haven't visited my parents and they didn't get to meet their grand children.

Alternate Documents: If an individual is born after April 1, 1970 and is unable to obtain a birth certificate, the individual must obtain a certificate of non-availability from the local authorities with jurisdiction over their place of birth. In addition to a non-availability certificate, the following  documents can be accepted as secondary evidence:

  • School-leaving Certificate (document provided to students when they cease attending a particular school, be it public or private),
  • Matriculation Certificate,
  • Certificate of Recognized Boards from the school last attended by the applicant (Boards are exams)
  • A notarized affidavit executed by either a parent, if living, or another close relative older than the applicant.  This affidavit should clearly state the relationship between the deponent and the applicant, how well the deponent knows the applicant, the date and place of the applicant's birth, the names of both parents, and any other related facts. If the applicant has no living relatives that witnessed their birth, a self-attested affidavit detailing their knowledge of the facts of their birth may be accepted.

Comments: For all births after April 1, 1970. It is mandatory under the law (as per the Registration of Births & Deaths Act, 1969) to register every birth with the concerned state or union territory.

 

I suggest following the directions in the RFIE exactly, while also including evidence in accordance with the reciprocity schedule for India (above).

I dont have a birth certificate since i was born in india before 1989, it was not recorded. it was not mandatory to get a passport with a birth certificate people born before 1989 in india  so i never had to get one.  I have submitted my Passport copy as a proof for my date of birth ( also added a note on the copy of passport saying i dont have a birth certificate so i'm including my passport copy as proof). now they sent  me the RFE  asking for prrof.

 

can anyone please elaborate what they asking in the letter.  thank you

Hey, I went through your post. I am not sure if you have already resolved this issue, but I remember a few year back someone I know didn't have a birth certificate either and they actually got one through the Indian consulate office . I believe you go to the Indian consulate office and can apply to get a birth certificate which will be a document listening your parents name, your date of birth etc. Check your local Indian consulate's website and I believe they should have this service. We were in New York, and this was done in New York.
