Hi Guys,

I hope everyone is doing well. I was wondering if anyone could provide their opinion on something that I want to do. I filed I-130 for my husband on July 5th after being denied for I-129F on March of this year. I read from many members in this forum that they filed I-129F after receiving the Noa 1 from I-130. I never did file that being afraid that I was just gonna make it more confusing for the person that was gonna handle my petition. I have been wondering lately if I made a mistake for not sending the I-129F. Should I still send it? What are your thoughts on this?

I just looked at your timeline, you got Potomac right? Probably not worth it as you shouldn’t be waiting too much longer for your NOA2 from there anyway. It’s only really helping people who got Nebraska (like us 😭) and some in Texas

I agree with @S&J2013 . being with Potomac, you already hit the jackpot!

I have Texas and haven't filed the 129-F. It's definitely worth a shot for Nebraska filers.

Potomac is processing June & May applications now! Just sit tight, your July application is movin right along!

The 129-f you filed before, it was before you were married, for the K1, right? Just curious if you know why it was denied?

It wasn't denied per say, but it was sent back to USCIS. When the embassy informed me about it, I just took the first flight went a married my soulmate and applied for I-130. :)

I really hope we all get an answer soon, being apart is hard on its own... let alone this process.

Thank you for responding

Hey guys. I want an advice. I want to expedite but not sure If to do it now or once it hits NVC. I talked to my lawyer about it but she told me this "unfortunately there is no way to expedite this process under current Immigration laws." I Still want to try and call to expedite...

I waa looking through these threads and saw all these optimistic posts.  I filed 130 in april and am still waiting.  From my understanding everyone in 2019 has an iOS number as it is the new electronic lockbox designation.   My case has been sitting in review at Potomac since may 2nd.  Would be interested to hear if any of yours go through faster.

I think you can always try, but my understanding is that it's much harder to receive an approved USCIS expedite, compared to the NVC stage. You can certainly call and try, don't pay your lawyer anything more to just do the call- do that yourself if you feel you have a compelling reason.

Here's some info from the USCIS on reasons they'll consider an expedite.

https://www.uscis.gov/forms/how-make-expedite-request

USCIS may consider an expedite request if it meets one or more of the following criteria:

  • Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to:
    1. File the benefit request or the expedite request in a reasonable time frame, or
    2. Respond to any requests for additional evidence in a reasonably timely manner;
  • Urgent humanitarian reasons;
  • Compelling U.S. government interests (such as urgent cases for the Department of Defense or DHS, or other public safety or national security interests); or
  • Clear USCIS error.

I think you will have approval soon! So many May and June Potomac applications are being approved lately. It's important to be optimistic whenever we can during this long anxious process :yes: Yes, everyone is getting the IOE receipt #'s now it seems, and hopefully their new process is to everyone's advantage!
