Timeline

Hello, I just realized I submitted our AP document with an older version than the current one.

 

I submitted OMB No. 1615-0013 which Expires 12/31/2018

 

There is a newer version since this one. Will I get a denial or RFE? Can I call them and/or re-submit? 

 

She's gonna kill me....

If you get it from the USCIS site it is the most current version.

 

I'm guessing it will be returned or RFE

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Apparently I did not. I may have started it in 2018, but didnt complete it until May 2019.

 

I remember I found a typographic error when applying for K1...I mis-spelled my wife's last name (she has 3 different ways to spell it! (Russians!))...anyways, they fixed that typo within 2 weeks, and I avoided an RFE...I am wondering if I can do the same here.

Once you get the AOS NOA1 you can refile the I-131 with a copy of the NOA1 and there is no charge.   If you send in the I-131 by itself they will reject for a payment.

 

Just hang on a few weeks and see.

Yes I have the NOA1...could refile if necessary. I hope they just accept it. Like you said, I can only wait. But I may give them a call just to make sure. Thanks for your advice.

Thank you. This confirms that the edition date is wrong. Our edition date is 'Form I-131 12/23/16 N' but it should be 4/24/2019.

 

Now, how do I fix it? I should send in the correct form with the NOA1 for my AOS or my AP document?? Or both?

 

Where do I send? Back to Chicago?

So use the AOS NOA1, not the AP NOA1? Where do I send, Chicago again?

Yes, follow previous advice....send copy of AOS NOA1 and new I-131 to Chicago address. Suggest that you also include an explanatory letter about your error.

FWIW, there's usually a 30-day grace period where the previous version is accepted (and the 12/31/2018 version was definitely the previous one, since that's what we filed with in April), so you might be okay. And usually if you submitted a version of a form that's not accepted, you would have heard something by now. So I'd wait to see if you get an RFE before re-sending anything.

While I tend to agree with you, we still have not received our Biometric appointment letter and we are waiting 62 days now, FWIW. I do not know that I can trust my instincts anymore. Im waiting for a USCIS TIer 2 rep to call me back in two hours, hopefully they can clarify. Thank you for your help!
