Over Age (My son is not on the applicant list)

hey guys 

well i just received all my login information from NVC, so while checking my son whose 26 years of age is not on the F3 category sponsoring. 

One the application section the CEAC website there is a tab called ADD APPLICANT. 

 

so I'm wondering if i should add my son on the list although he is 26 years and pay is visa fees or should i contact NVC ?

 

i need some advice here please help ASAP

This can only be answered if you know his CSPA age. If his CSPA age is over 21 he is ineligible. Do you know how to calculate this? (Google CSPA calculator ). Alternatively post priority date, approval date and his birth date and someone here can work it out for you.

Well my son age is 26 

Is DOB is 1992 October 3

Ans our piroirty date is 2007 July 20

Approval date is 2010 February 18

 

Can you please help me out

He has aged out. There is a limit on how old children can be added to that category. He is considered an adult and will have to find another way if possible. CSPA helps but it only helps for a certain amount of time.

So which mean he won't make it to go in for the visa interview

Yes. And even if he is able to make it to the interview, he will not be issued a visa. If he is truly aged out (and by our calculations... he is), it means he is not eligible to receive a visa per that category.

This is what the calulator is saying his CSPA ages is 14 years

The visa availability date is wrong. The date there should be when the PD first became current, not when the I-130 was approved.

 

Using the calculator the way you did, it would be impossible for anybody to ever age out. Notice that the "CSPA Age" in your screenshot is the age of the child at the time the petition was filed.

That is what I got when I currect the availability.. That my son is still eligible

How did the petition pending duration change from 2 years to 11 years??? It was right the first time. The petition pending duration is from when the I-130 was filed until it was approved.

 

Again, in that calculation, it would be impossible for anybody to age out.

Ohh well the approval date for the petition is 2010 February 10.. 

 

And the piroirty date is 2007 July 20

So you can subtract the time from the date the petition was received (priority date) July 2007 from the date it was approved, February 2010 and take that number, 2 years 7 months and subtract it from his actual age to get his CSPA age of 24. He has aged out.

Sorry, there is no possible way for your son to immigrate with you.  Even if he gets into the interview, the CO will follow the law and deny him a visa.

 

You are entering the wrong date for the Visa Bulletin Current Date.  It's not 06/05/2007.  The current PD in the August 2019 Visa Bulletin is June 22, 2007.  So, your PD is likely to be current in the September 2019 Visa Bulletin.  You must use 09/01/2019 as the Visa Bulletin Current Date.  If you do that, you will see that your son has aged out.  The CO can not ignore the law.  They must follow the law and can not issue a visa to your son.

 

Once you enter the US and become a green card holder, you can file for an unmarried son over age 21.  That is currently taking about 6 years.  Your son must stay unmarried the entire time.  Marriage will automatically void your petition for him.
