I-485 filled, seperated HUSBAND REFUSES TO GIVE ME MY MAIL

So we filed for my I-485, I-131 and I-765 a month ago. USCIS has sent me three mails (USPS tracker). Me and my husband are having marital issues and I moved out and now he is refusing to give me my mail back and even signed stuff on my behalf and sent back to USCIS.

 

What can I do? 

I already changed my adress.

hi,

 

who is the petitioner, are you petitioning for him or is he petitioning for you? if he is filing for you, he can cancel the petition at any time, you don't live together any longer so the petition can't continue.

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

There really isn't anything that needs to be signed and sent back. SO I'm thinking he sent a note to withdraw the I-864 since you guys will be divorcing then there is no reason for the AOS.

 

Also have your mail forwarded to your new address. 

 

Think you may get ready to go back to your home country.

and cancel the i485, not only the i864, he can do that too,  he can also write a letter cancelling the i485, whoever is the petitioner

The sheriff can escort you to get your mail and anything else you own.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There’s nothing for him to sign anyway. If he’s sending mail back as you don’t live there anyway, that’s a perfectly acceptable and legal response. If he’s not sending it back or forwarding it, then that’s an issue. First ensure the address is updated so it’s not sent to him, and second you can contact local police to escort you to get what mail he has.

 

That said, there’s not going to be much mail. Either an RFE/RFIE, interview notice, or denial. Either way, the end result is going to be the same without his support.

My assumption is OP is looking/hoping for another avenue to remain in the US and adjust status since separated from her husband/perhaps husband is contemplating divorce.

If you are adjusting from K1, moved out, and he pulled his support affidavit then you didn’t move far enough.  You have no path to remain in the US.

 

There is nothing to sign for from USCIS.  If he marked mail “return to sender” or even threw it in the trash after you moved out then he was within his legal rights to do so.  It is not required that he hold your mail for you.

He cannot cancel the 485. That is filed by the immigrant. But, he can withdraw the 864....

Finally done...
