Hi all,

I have a question about the information that I copy below, it is from VJ guides..

"Entering the US on another

type of visa, such as student (F-1) or H1B, followed quickly by marriage to a US citizen, and then followed

quickly by an application for adjustment of status might be construed by the USCIS to be visa fraud."

http://www.visajourney.com/forums/index.ph...p;page=otheraos

My story:

I came to US in 2001 for Graduate school, found a job January 2006, start working with my OPT..My company applied H1-B for me, it was approved and I was under H1-B since October 1, 2006.. I went back home for Christmas, US embassy stamped the H-1B visa to my passport in late Dec, and I came back to US first week of January 2007..

I proposed to my Fiance, in January, and we got married in May 2007, and sent AOS and EAD in May 2007.. Is it considered too quick to apply for adjustment of status after entering to the country?? 5 months? I have been living here for 6 years, and I have been living with my fiance for 2 years..

This sentence in that link really bothered me so much, If knew that I didnt apply for change of status..

Does anybody have similar experiences? What you think about this information that I copied the link above?

I hope someone can clarify it to me..

Thanks a lot,

Oliver

That statement says that if you came in with your work permit for the first time and then got married like the next day, that'd be fraud, cuz that wasn't the reason for your trip

Students for other countries come and study and then get married down the line all the time..

you have proof of your ongoing relationship over the past 6 or so years so it should be fine

don't fret.

Thank you. I hope they look at everything I have submitted before even thinking of anything like that.:(

Does anybody have similar concerns, problems before?

Thanks,

Oliver
