My sister-in-law's finace travels around the globe for his job. If she is granted a K1 visa, comes to the US, gets married and then he leaves for France due to his job. Will she be okay submitting green card paperwork? His lawyer is saying it's not good. Just wondering if anyone else has been in this situation or knows someone who has. He can come to the US on a visit visa, get married, then leave for work while she files a petition for CR1.  Problem solved.  No need for a K1.  If he leaves without advance parole (3 months from filing minimum) she will have to refile a spousal petition anyway.  So why file for K1?

I think you have the people reversed. It is the USC that will be working overseas, not the beneficiary.

This exact same issue came up a few days ago.  

 

Advice was to get married, then file for CR1, leave the country for work while the immigrant visa is being processed and immigrant is still in home country.

 

It is not advised to abandon a K1 immigrant during AOS.  No job, usually no drivers license, in a strange country, and alone while being expected to chase paperwork, attend biometric appointments, and be independent?
