Hi everyone, 

 

I attempted to use my father as a joint sponsor for my wife's visa application, but I just received word that he does not qualify (with no explanation, of course). I was also directed to add him as a household member. I am trying to get through to the NVC right now about this, but since they are not picking up their phones, I thought I might as well ask you all the following questions. 

 

(1). Is there anything about my case that strikes you as an obvious reason why my father would not qualify? As far as I can tell, he meets all the requirements as specified in the electronic code of federal regulations. 

(2). Why would the NVC recommend that I add my father as a household member? I am over 18; my parents and I file taxes separately; and we have had a distinct principal residence for the majority of the year.

  1. As long as he is a USC or LPR domiciled in the US, he should be eligible to be a joint sponsor. However, his circumstances may or may not make him a suitable joint sponsor. Also, the evidence provided with their I-864 needs to be complete or else they will reject them as a joint sponsor as well
    1. What documentation was provided with his I-864? What is his household size? What is his income? These are not nearly all the factors considered, although NVC usually does not delve too deep into the specifics...the CO will do that as they have the final say on the public charge issue. NVC only does an initial review to ensure required documentation is provided and the minimums are met.
  2. Did you claim to live at the same address on your I-864s?

1. This seems right to me. My father is a USC. Perhaps there is something about his financial circumstances that the NVC doesn't like. He owns his own business, and while the last two years have offered income well-above the required 125%, his income for 2016 was quite low. 

 

2. Yes, I am currently in between apartments (completed an MA in May and off to law school next month), so we share a physical address currently.

Finally got through to them. I was told that because I share a physical address with my father he cannot qualify as a joint sponsor, and I must report him as a household member. This is odd to me, since I have not been listed as a dependent on my parents' tax returns for about five years now, and I am only staying with them over the summer. But, according to the customer service representative I spoke with, all that doesn't matter.

I see what they're saying, but that is contrary to both the instructions and the norm.

Personally, I wouldn't argue with them about it and just get it through NVC. But have the I-864 for him as a joint sponsor also prepared at the interview. The CO will know what is needed better. NVC is just a document preparing and processing place for the embassies/consulates, who only do a very cursory review of the I-864.

Hello there! The same happened to us for my husband's case. We added my dad as a household member and my brother as the JS, however we couldn't upload any docs and upon calling nvc they said we must add them both as household members as they r residing at the same address here in the US. Once I uploaded both as HMs all the documents were accepted. We initially had my brother fill the I 864 as a JS but then had him fill out the I 864A as the HS upon being told by nvc

That's very encouraging to hear! Out of curiosity, did you (the petitioner) submit a new i864 after adding your brother as a household member?

No. My I 864 was accepted without question (Thank God!) Just my dad and brother had to submit 864A and they too were accepted a few days after we uploaded their documents.
