Little late is they are already married

I realize that.  What I'm getting at is that submitting the 129f as  K-3 wipes out the primary advantage of the spousal visa....

Yes that's true. It's pure emotional route.

I hope the K-3 filers are prepared for the possibility that some of them might actually be approved.......not likely, but possible.

Don’t forget that even if their I129f gets approved before their I130 they still have the opportunity to just wait on I130 to be approved and not move on with K3 process.

So it definitely win win. Some prefer to be together right away and go through AOS, others prefer to wait... and K3 filers IF I129f is approved faster have the choice :)

You are absolutely correct.  I’m traveling to Morocco every three months at $1000+ a pop.  Even if they decide to do the AOS fee for the K3, if my husband is in the states in 1/2 the time it still ends up saving me thousands of dollars commuting back and forth.

Yeah tell me about it! I spend $2500 twice a year for the last four and half years to see my husband in India. I would pay anything to have him here with me now! I don't give a ####### about spending money on applications at this point. I am tired and want my husband here with me.

The I-129F petition for K3 visa is intended to be filed with the I-130. I would assume they are sent to the same SC.

Yes, my I-130 & K3 ended up at the same service center. But according to the website, the processing time is faster with the K3 visa.

I am lucky to be assigned to Potomac. It's not about me though. it's about people who are waiting while tons of I129f are being adjudicated. You said you don't even care if I129f is approved just so that your case is being looked at faster and you know i129f most likely won't be approved. And hell I don't even blame you. But admit that it is ultimately "gambling the system" like someone said earlier.

Well I thought I would update everyone.  I did file the I129F and was approved 5 weeks after I submitted our second I129F.  Absolutely no gamble.  Also since my original post, I’ve discovered that the USCIS has been processing I129F K3 visas this way for a while.  I found a lady that had one processed in mid 2018.  Also, just an FYI, it seems now the only time an I129F is approved for a K3 is if the I130 has an RFE.  And with the over 55 cases I’ve tracked, the I129F is has always been connected to the same service center that the I130 was sent to.  This has been consistent with both Texas and Nebraska.

  • Did you File a I-129F (e)?

Yes. It’s notification date was 06/28/2019 (82 days ago).

This is another great example of how they're processing the I-129Fs. Jacob's I-130 was sent in on 06-03-2019....and three months later received an RFE. This is orders of magnitude better than waiting a whole year for a RFE disposition...

I'm also quite sure that if his I-130 case was solid, it would've been an approval and not an RFE (not sure what caused the RFE though).

Also, another post yesterday got an adjudication on their I-130 after 65 days of submitting their I-129F. Seems like they're continuing to process the K3 applications in this same manner.

I mailed my 129f on Friday 9/21/2019. My I-130 has a PD of 8/29/2019. It is being processed at Nebraska Service Center.

My receipt number for the I-130 starts with IOE. We will see how this moves forward. 😬
