Hi,

what is 1099 form?

My wife is the sponsor and she works as a teacher.She said she didnt have something like that.

Instead she had something like 1040.Would that be ok?

And we put the below as the documents

1. I-864

2. Proof of current employment ( A letter from her employer that indicates when she started, how much she gets ect.)

3. Copy of payroll of April 2006

4. Copy of W2 of 2006

5. Copy of Form 1040 of 2006

Are these all needed? Are we missing something?

Yes these are more than enough. 1099 is another tax form used in some special cases. We sent W-2, 1040 and a few paystubs with I-864.

08/11/07: EAD start date (since no update online, I assume this is the approval date)

08/13/07: Touched-I485

08/20/07: Got EAD in the mail. (No touches and no email notification) (Day 78)

08/21/07: E-mail notification for EAD

08/27/07: Interview (Day 85) approved, but had to resubmit the birthcertificate

09/26/07: birth certificate is submitted, passport stamped. Receive "card production ordered email"

10/04/07: "Welcome U.S.A." letter received.

10/10/07: Green Card received. (Day 129)

Your list is complete, not everyone get 1099 forms, they are used to report other income like from investments, or sometimes side work.

I havent got any NOA from USCIS, but as far as I understand, there is number on the NOA paper that allows you to follow your application status. When it says "touched" I think it means USCIS takes a look at your application, or papers etc.. As I said, I havent reached that point yet, I sent my application on May 24th, and havent got my NOA.

If your wife had any additional income, you HAVE To include form 1099. People here on VJ have gotten RFEs for not submitting their 1099s. If of course your wife didn't have any additional income, you can't include form 1099 (you can't include what you don't have). Examples of additional income are: interest, retirement, dividend

@lucky_star: You HAVE to submit your tax returns for 2006. Submitting tax returns for 2005 and 2004 is optional BUT HIGHLY RECOMMENDED. Also, as stated above, submit form 1099 if you had any additional income.

You might be missing something. A photocopied tax return should be the complete return as filed with the IRS. Many people's tax returns contain more than Form 1040 and Form W-2.

The simplest solution is get tax transcripts from the IRS, they are acceptable in place of the (1040/W2/1099...) per the I-864 instructions.

I had additional income in the form of a second job and child support. I did not have to submit a 1099 for either. I submitted my tax returns and the tax transcripts for both incomes and the documentation that proves what I receive in child support from my divorce settlement. My I-864 was accepted and my husband's AOS has just recently been approved.
