Absolutely allowed. Entry is at the discretion of CBP, but a 12 day trip in December is unlikely to be an issue for a VWP traveler.

Hey guys just a quick question

 

I am looking to visit my wife (US Citizen) and me (British Citizen) I’m looking to visit her for Christmas and her birthday I’m only going to be there for 12 days and I have a job which I can get a letter of employment just wanted to know can i visit her while our application is waiting to be approved has anyone done this and is it allowed?

If you search around here you will find lots of people who have.  Though I still see people warning others or getting advise from lawyers saying not to.  I think it depends but it seems generally safe.  I just sent in my i130 for my wife.  We live in Hong Kong and plan to be heading to US for two weeks late October.  And likely one or two other trips until she gets her visa.

Yes, it is allowed. 

 

Many of us have done so. I visited several times during the process. No problem at all.

No, I'm the US Citizen. My wife was unable to obtain a tourist visa (norm for a single Filipina).

Where they abit fishy or not really so when they say purpose of travel? I’m just gonna say visiting my wife for 2 weeks for Christmas 
 

i should be fine? I Own a bakery with my dad so I do have ties to go back home

HI, my husband (UK citizen) has visited me in the US 3 times in the past year since we started the cr1 process. Visits ranged from 10 days to 3 weeks. He never had an issue, they only ever asked to see return ticket. He just told them he's visiting his wife. He is flying in tomorrow for my birthday, this is his 4th visit in a year. I will let you know how that goes 😊

Not really. One questioned me intensely and kept trying to make me say that I was planning to stay. But on all other occasions it was quick and painless.

 

Always tell the truth. You don’t have to provide any more detail than necessary but any question that is asked must be answered truthfully. 

 

I know that some forums will advise you to be vague and just say “tourism” or “pleasure” when they ask your purpose of visit. But that rarely flies when a solo traveler arrives at the border staying at a residential address in some small

town that the CBP officer himself has never even heard of. And they have made multiple visits to that same address (they keep the address you write on the blue form on your record). CBP officers are not stupid. They know what’s going on. It’s not illegal to date or marry an American. It’s not illegal to visit during the process. It is illegal to lie to an official.

Thank you that is great to hear!   Has he applied for an ESTA while case in progress or did he already have one before it all started?

Thank you!  Always encouraging when I hear these stories as we'll be doing trips as well.  I am the USC, my wife is Chinese and was born in Hong Kong (where we live now) and has Australian citizenship through studying/living there so we are using her AUS passport to apply for the green card.  I'll be with her most of the times she visits the US as we are currently all together here but the trip I'm worried about is she might need to come to see the kids off to school next September 2020 (USCIS just received my i130 yesterday so I'm not thinking shell have received her visa by then) and want to stay for a couple months to go back to HK just for her interview at the consulate.  I would hope the CBP guy would understand this but you never know I guess!

He already had one when case started, it has expired this year in July, he renewed it with no problem

Just to let you know, I travel yesterday to the US ,CBP office just ask purpose for traveling and I told him to visit my husband. My paperwork is at NVC. So yes you can travel but be upfront with CBP officer.
