I hope she has proof of filing her I-485 or proof of an unexpired I-94 with her...

We Are Not going now lol.

Just like y’all have also repeated my original thoughts.

It is not worth the risk unless she has AP already.

She needs her NOA from filing her I-485 or proof of an unexpired I-94 where she is......so close to the border....imo.

She has her I-94 with her anyway. There is a border patrol checkpoint we will be going through on the way back from Del Rio.

Not because of that, but because of your proximity to the border.  CBP checkpoints are set up on the US side.

Yes. We went through a checkpoint coming back. Her passport and I-94 was enough for the border patrol officer.

When does her I-94 expire? Next week? After it expires she can carry a photocopy of the I-485 receipt notice as proof of "authorized stay" allowed by the US Attorney General.

On the 10th. We have been wondering what shows that she can stay past that. It would be nice to get an updated I-94 or something after we file for AOS.

We will keep that in mind. Thanks!!!

I believe the only thing you will get is a NOA showing that the I485 is filed.  I don’t believe the I94 is updated.

If her i-94 expires on the 10th you need to file for AOS immediately!  That's only 4 days from today.  After the 10th she is out of status and without proof of filing AOS she is at risk for deportation, especially living so close to the border and passing through CBP checkpoints.

We filed for AOS at the beginning of May.

Already done and waiting :)

My wife and I are still waiting on her travel permit. We are in Del Rio right now and have read that although the K1 is a single entry visa you are allowed to walk across the border to Canada or Mexico.

We were wanting to visit Mexico for just an hour or two if this is 100% true. Thanks in advance!!!

I'll wait for a post in a week or so saying:

'Help! Beneficiary crossed into Mexico and is now stuck!'

The terms of the process are clear. You can leave the USA at any time you please, being legally admitted back in is another matter entirely. It violates the conditions of the K1 to leave and come back, as it is a single use visa. Once you enter, consider it no longer in existence. You have to wait for EAD/AP or LPR card. I know it sucks, I just waited about 9 months for both. It's not worth the risk.

Why the heck would you guys wait so long to file? Not trying to be rude or anything, but isn't that like roulette? Particularly given you're right by border checkpoints.

The more cases I see with later filers, the more I think my wife and I were extremely prepared. We filed about 1-2 weeks after our wedding once we got a marriage certficate etc. No reason to wait, all it does is prolong the period of being unable to work or travel
