120 days after N400 interview

Good question. Because after 4 years of inaction, they took action immediately after a new application was submitted. There were no legitimate reasons for delay. in fact, at different points of the follow up it became clear they could not locate the original application, as VSC said that New York office had it, and New York office said VSC had it.

Timeline

Waiting for four years is a true nightmare! I can't even imagine. After I passed my interview, the officer said that once the file from California arrived (which he predicted  Monday the 18th March), the supervisor will approve my case. I have been trying to piece the puzzle but there have not been many. Now I just need to wait.

But you said earlier that they approved the initial application, not your second one. You could've accomplished the same thing, much sooner and several hundred dollars cheaper frankly, by filing a petition for a hearing on naturalization -- 1447(b) suit -- pro se, or without a lawyer. USCIS magically finds cases when a judge is looking over their shoulder.

Those guys in the field offices are absolutely terrible and there's no harsh word that i can even think off and use for them but since this is a forum i'll try to be civil. I applied for my N-400 application in June 2017 and did an interview in early September. I passed the test but the officer said he needed to review my file more. Fast forward now, we're in July 2019. I have attended about 6 infopasses, done 8 service requests, contacted congressman, contacted  senator and even contacted Ombudsman. None of them have been able to help me at this point. It is always the stupid and vague letter saying that it is "pending administrative processing". These guys are just incompetent. Mind you i do not have any type of criminal background.

 

That leaves me with the final option of lawsuit. I consulted a lawyer about this and he quoted me around ~$7000 for the lawsuit. 7k is not cheap by any means so i am not going that route. I am still waiting for a response as we speak

I attended one infopass, one letter to the Congressman, one pending service request via phone, another one online, one letter to Senator and a letter to Field Office. I am waiting until Monday to make another service request. Best of luck!

What would you do if you were in my shoes. I see you've had some success with dealing with USCIS.

 

i do not want to go through the lawsuit route because it's expensive. sure, it'll be slightly cheaper if i files the suit on my own without an attorney.

 

suggestions?

It would be a lot cheaper to file the suit yourself without an attorney, not just "slightly".

I agreed with hypnos, a lawsuit filed by yourself is a lot cheaper. There must be links somewhere on the Internet. Please share if you encounter one. I will keep you updated on mine.

Hi all,

 

So far I've got two pending service requests. On Monday July 15th, my field office called me and the gentleman seemed surprised that I even put in a service request because according to him, I didn't even attend the interview; they admitted the fault and stuff. They are still waiting for a file to be sent in, and currently in USPS possession and in transit. I have no idea what kind of file that could possibly be. Yesterday, my Senator promptly submitted a congressional request, still don't know how long that would take and it would actually help at all. It's been over 120 days! I also sent a letter together with all related files to my case on Friday 12th which was received on Monday July 15th. I am not sure what triggered the call,  the letter I wrote or one of the service requests I made (one over the phone, the other via online portal). I am clueless what to do next. I called District Court yesterday they suggested I call the 1800 number to schedule a one on one appointment with an immigration officer; if they can't resolve the matter, they then will schedule a hearing before the District Court.

 

So basically USCIS has no idea that I even attended the interview! USA 2019 everyone!

May I ask who did you send the letter to? I'm in similar situation being over the 120 days with 3 service requests and no further action.

Unbelievable!!!!This is ridiculous.May you have your positive outcome soon.
