Greetings Everyone…

First let me say Jim got his K-1 Visa last week. When he got home he scanned it and e-mailed me the picture. My heart gave a jump at the wording “TO MARRY UNITED STATES CITIZEN” followed by my name.

We couldn’t have done this without all the information on this site. 99.9% of our questions were answered and the process, although at times seemed daunting it truly went without a hitch, no problems.

“Going to the chapel, going to get married”

Now as the wedding date approaches I need a few clarifications on the Application for employment. If Jim is not planning on working right away do we still need to file the I-765 form or can we just wait for the Adjustment of Status to be approved? My thinking is if we don’t need to it while file it and save that $$.

I agree, if he does not plan to work right away then there is no need to file for the work authorization. Just keep in mind that AOS times vary. Some get their AOS approved right away and others get stuck on name checks for months, which in that case it would be benefical to have the work permit.

One thing is, AOS might take a long time. Some people get held up in namechecks for a year or more, so filing for EAD is sort of a backup plan.

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

I agree.. it's a risk that you just have to weigh pros and cons.. in our case it gave us a week of Employment Authorization and then our Green Card approval came.. BUT there are other timelines that they wait much longer for their GC. We felt the gamble of NOT having it was not something we were willing to take.

If you can afford not to work, you probably can afford the 175$ or whatever it costs to file the paperwork I figure.. that way you have the peace of mind that if some amazing job comes up you COULD take it. But really if a job is not something that's going to be sought after.. heck why bother! :)

Please remember that if you are filing for AOS after July 30th 2007 then the cost of the EAD is included in the AOS fee.... along with AP... so you will not be saving any money...

Wow I looked at the new fees..

I'm sure glad we got our stuff done when we did. We are getting married the 7th of July and will be submitting our AOS very shortly after that.

Jim is retired from the Canadian Navy and has his pension so there is no need for him to work (we are lucky there) and we will have my income...so we are good to go!

What did he do in the navy? I was int he Cdn Navy for 10 yrs, prior to remustering to the Air Force. Been down in the USa now for just over 2 yrs just going to school, and officiating hockey.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

He was an Engineer and yes he has all the stories…lol

I have a friend here in the US that is also retired from the US Navy and I told him when they meet, they couldn’t talk about the women they dated…(I’m sure they dated the same women), they sure enough drank in the same taverns and can describe the place right down to the table cloths.

WHOA. Am I reading that link correctly?

To file the I-129F will now cost $455, up from $170?! And to adjust status is $1010?!!! What is it currently??

Depends on what you mean that he is not planning on working "right away"... Do you means a few months or a year or longer ??

If you are talking about a year or longer then you would probably be safe in not applying for the EAD but if you are talking a few months then you might want to consider applying for the EAD ...

Many people get stuck in the FBI name check and can wait a year or longer for their green card ... I was a lucky one as mine only took a few months but we did apply for the EAD as I wanted to start working as soon as possible ...

Of course we got the green card before we got the EAD so in our case we "wasted" the money but old Murphy would have got us if we had not applied for the EAD ...

What do you mean by this? I've been trying to figure it out. If the EAD is included in the AOS fee, then by not filing for the extra EAD, it seems to me that $340 would be saved. How is it included in the AOS fee after July 30th? In this link that someone posted, BOTH AOS and EAD are listed.

Q. If an applicant files a Form I-485 to adjust status before the rule is effective, will he/she have to pay

for future interim benefits?

A. Yes. An applicant for adjustment of status who applies before the fee rule becomes effective will continue to have to file separate applications with fees for employment and travel authorization. Those who file an adjustment of status application (Form I-485) after the new fee schedule is effective will not have to pay the additional fees for employment and travel authorization as these costs have been included in the new

adjustment of status application fee.

It means that you will not have to pay $1010.00 for AOS and $340.00 for I-765 (EAD) or $305.00 for I-131 (AP) as both are included in the cost of AOS
