They ARE NOT US citizens or residents. The Constitution is designed and meant for citizens and residents of the US. It does NOT guarantee anything for combats of war. That is where the Geneva Convention comes into play.

Well that's the thing about that whole "legal combatants" designation. The Geneva convention (apparently) doesn't apply either - so if you're not a US citizen, and if you're not part of an organised armed forces - there's no constraints on how you can be treated. Theoretically.

Damn quick edit wouldn't work. I meant to say they are COMBATANTS OF WAR. Only the Geneva Convention applies to them and the whatever human rights they get from it. IF IT APPLIES. Not from The Constitution that states "All men are created equal". Our rights under The Constitution do not apply to any people from any other country within their borders. As well as NO other country's laws do not apply to us within our borders. :thumbs:

But that's just the thing - its been made clear that the Geneva convention does not apply to anyone but uniformed soldiers. That's what makes some of this stuff very distasteful - using semantics to twist legal definitions.

You are absolutely right erekose! Terrorists will not become uniformed soldiers. They have no regard for who they kill and where they do it. So it is rightfully so that they don't deserve ANYTHING under the Geneva Convention. :thumbs:

Without wanting to open up old arguments - I don't condone terrorist tactics, but I see plenty wrong with that.
