Long term work assignment

I filled out a K-1 visa for my fiance but I have since learned I will be going on a long-term work assignment. I am a defense contractor for a major Aerospace company and my home address and pay will still be in the u.s. I will just be on International assignment. Would that qualify for expedition? Thank you for your time

  • Severe financial loss to a company  or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to file the benefit request or the request to expedite in a reasonable time frame; or (2) to respond to any requests for additional evidence in a reasonably timely manner;

  • Urgent humanitarian reasons;

  • Compelling U.S. Government interests (such as urgent cases for the Department of Defense or DHS, or other public safety or national security interests); or

  • Clear USCIS error.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thank you for your response! I will be going to work on a US bought military plane in an other country. Could one argue that is in national security interest if they are our ally?

How does it benefit the interests of the United States for you to expedite a K-1?  There are other factors for you to consider, also.......what happens after you marry inside the US?  Where and how will your new spouse live?

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Let's say you got approved yesterday and she moves to the US now.   She will be alone while you live abroad. She can't drive, work or travel.  Is that what you are asking to do?

Well we filled out the Visa before I got the assignment so I'm just asking some general questions. I thought after we are married she could freely travel in the United States but also she could probably stay with my parents as that will be my place of residence

That said, what's the plan if it works? Marry in the US within 90 days then move abroad for the work assignment?

She can freely within the US. She cannot leave the US until either getting AP or Green Card.

For approx 6 months or longer, she will be in state of limbo (no legal status) without the ability to work...and possibly without the ability to drive, open a bank account, drive, etc........

She needs to complete AOS in the US after the marriage. Just being married to a USC grants no status or legal stay.

Showing a bona fide marriage (for AOS) when you live apart is difficult (not impossible).*

 

*Military spouses are unique and living apart is not an issue.
