Timeline

I have Married to American citizen since 2015 and I joined her in America 2018, in a couple months she started abusing me and later I found out she is cheating on me I have evidence, after I found out. she told me to leave her house. And i asked her whether she will  signed a divorce paper and She said no. she not ready.and she will not do that. but I should leave her house to find a place to  stay. for now I have 10years greencard, it left with 1 year 6month to file for my citizenship So when I leave her house will it affect me from obtaining my citizenship?

Leaving the house will not affect your immigration status. For citizenship you have to be “in marital union” with the same USC for the past three years to file under the 3-year rule. If you are filing under the 5-year rule then your marital status is irrelevant.

NOA1: February 8, 2016 Nebraska

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Wait and file under the 5 year rule. Far less intrusive about your life anyway and requires much less documentation.

 

You don't need her to agree to a divorce for you to start proceedings. My ex didn't want a divorce either when I found out she was cheating on me. Told her infidelity was a bright line for me and we were done even if she didn't agree. Don't let your wife dictate how your marriage will end, go ahead and take control.
