NVC Filers - July 2019

Hello friends, please help me as I’m confused. We have submitted I-864 (my daughter) and added household member I-864A (my mother) as extra income cause we thought my daughters income wasn’t sufficient enough. Today I’ve received email that all documents were accepted and household member I-864A was rejected.  NVC responds saying we need to add my mother as joint sponsor, which is a new I-864 form. BUT, my question is if my daughter was accepted then do I need to submit extra joint sponsor or leave it empty? Should I call NVC? How do I know if everything is great and that it’s case complete? I am worried that if I submit new documents that I will have to wait another 3 weeks for them to review!! Ughhh Any help I get I would be grateful. 🙏🏼

So, your daughter is the sponsor and petitioner, correct? Does your mother live with her? If not, she is not a household member. Make sure you follow the little chart on the NVC page for which type of form applies to whom. Also, if your daughter doesn't make enough money to sponsor you and your mother also doesn't have enough.... AND they aren't eligible to be household members, you may run into a problem. You might want to run this scenario by some of the senior members in the processes forum. My understanding is that each sponsor or joint sponsor has to qualify on their own, unless they have a qualifying household member that they can add, such as a spouse or child that lives in the same house. If you are trying to add the income of two people together that do not live together, they will not be considered qualified to be a sponsor. If your daughter was accepted as a sponsor and makes enough income, you do not have to add your mother as a joint sponsor, but I thought that NVC is the only one that can remove a household member or joint sponsor once they have been added. I'm surprised the person you talked to didn't know that. I don't think there is any way for you to do it online. Hope this helps and I didn't just confuse you more.

Thank you for the input! Yes, my daughter is the sponsor and petitioner. My mother does live with her. So total of just the two and no one else. My daughters form was accepted even though she doesn’t meet the guidelines, a bit confused there lol 😂 That’s why we decided to add income of both (petitioner and grandmother) We thought it was form I-864A but NVC said grandma has to be joint sponsor. So it would be two separate Forms I-864 :)

I just emailed NVC so they can delete grandma as household member and add as joint sponsor. Not sure how long that will take?! We will go ahead and submit ASAP and hoping it’s not important for them to delete anything! 

We assumed we submitted everything correctly but seems like we were wrong. I’m praying they respond and accept the new form as this whole process is giving me more grey hairs!

As the petitioner, your daughter has to fill out the I-864 even if she doesn't meet the income requirements. She is the primary sponsor even if she has no income. So, they accepted her form correctly. I believe on reading further that a household member can only be a spouse, parent, or child, unless she is claimed on her grandma's taxes as a dependent. So, that is why she wasn't accepted as a household member and must be a joint sponsor. You might want to go online now and see if allows you to add her as a joint sponsor (before they remove her as a household member). It may not if they see that she was already listed as a household member, but you might be able to. You can then get a headstart getting all that stuff uploaded in the correct spot. As for email, they are not always quick to respond, so you may end up having to call them back and have her removed. This stuff can be so complicated. Good luck!
