Timeline

Can any international airport be a POE? Since I've been here I've only seen people mention a few locations. Some of the really large airports i.e., JFK, O'Hare, LAX.

The closest international airport to me is BWI, and he's flown in there many many times....I'm just curious :)

June 21, 2007 INTERVIEW DATE

July 21, 2007 Arrived in USA! Together at last.

Aug. 7, 2007 MARRIED!!

Aug. 21, 2007 Mailed off AOS & EAD Application (along with a whopping 1010.00!!)

Aug. 22, 2007 Application is signed for at the Chicago Lockbox.

I'm pretty sure that the answer would be yes(someone can correct me if I'm wrong). Any airport that you fly into from a point outside of the US as the first airport you fly into is a POE. Your SO will have to go through immigration and customs at whatever they land at first. So, if that is BWI, then that is the POE.

05/30/2006 - Green Card arrives in mail!! - Waiting for SSN now

07/10/2006 - The big move to Ohio!!

07/11/2006 - SSN doesn't arrive in mail, Anthony applies in person

07/18/2006 - Received SSN!!

08/22/2006 - Anthony gets his Ohio drivers license - journey is finally complete!!

I hated to think of him dealing with an airport the size of JFK if he can fly a direct flight into BWI via BA. I really appreciate your help.

I was reading another thread over here...as I'm finally starting to visit this forum now with our impending interview date.

How do you get a "work stamp" at POE ...can you apply for the EAD before he lands here? I thought he had to wait till he was in the country and living here to apply for a work permit?

What you are reading about (I assume) is a temporary EAD stamp. By temporary, it means it is good for only 90 days.

It seems JFK (and maybe a few others) issues this stamp automatically, while others you have to ask for it, and still others don't issue it no matter if you ask or not. So it's not something applied for, it's more or less dependent on the POE (I know, it doesn't make sense why some are different..but).

You can't apply for the EAD outside the country - technically you have to be married (presuming entering on a fiancé visa), then file for AOS (and EAD although not everyone files both).

I guess you would ask the officer. Only way to get the 90-day EAD prior to landing in US is if you ask for it at Dublin, Shannon, or one of the 8 Canadian PFI's (AND the officer grants it).

For K-1, no way to apply for "regular" EAD prior to landing; in fact, the holder must wait until AOS is filed (the EAD and AP applications can be sent with the I-485 as "package deal").

BTW, I'm all for landing at the closest airport to home for immigration/customs clearance (and I don't even restrict this to US).

Yes BWI is a POE however they do not issue EAD only JFK seems to do this. Maybe your SO could come in via JFK?

Slightly better option would be for Craig to come through JFK and then fly to Reagan National (DCA) or Dulles (IAD); the traffic pitfalls from both are worse (actually, with the traffic, one can go more quickly from Balto to Philly International--PHL--than to IAD) than from BWI.

Really, it should be weighted as "is the 90-day EAD absolutely necessary?" -- it is highly unlikely (even if the wedding is done one day after the foreign K-1 SO lands--or even the extreme case of the foreign SO landing in early morning and legal wedding same day) that the I-765 will be processed by day 90 after entry.

The obvious advantage of BWI is that of having the immigration/customs clearance at the point of destination (no further headaches of flight connexions that could be missed, etc).

So let me get this part straight...the EAD CANNOT be filed until you file AOS (I hate abbreviations *L*) and you can't file for AOS until you are legally married, so for example if I am marrying a take charge career oriented sort of male, the sooner the wedding the better? *L* (and thanks for the tips on JFK...it's appreciated!!)
