Hi,

 

i have a question regarding my friend, His spose is a US citizen  but currently in UAE but she will be moving to Pakistan in following weeks, She has never worked in the US but overseas she has. 

 

How will she file for him? and where will she email the paperwork to ?

since she hasnt worked in the US, she is planning on using her family to sponsor.

 

Please advise as how they she can apply for IR1 visa and how they immigrate here?

I'd advise your friend to get a free account here and read the guides at the top of the page.  She is going to have many issues to deal with like filing back taxes and establishing domicile in the US.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Yes, if she owes them to the US

She needs to use the search field in the upper right of each page.   Plenty of info already here.

She will need to both have her taxes filed (if required to file...USCs are taxed on worldwide income) AND US domicile (or show sufficient intent to establish US domicile). She will also need to be able to financially sponsor her spouse (see the I-864), either directly or with the help of a joint sponsor.

Where do they plan to live?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

your USC friend needs to look at the IRS information and file all tax returns for the years worked outside the US/ there is a tax exempt from federal taxes but she will owe as said above into Social security and medicare (the amount will be according to the tables on tax instructions

she will be the primary sponsor and can use parents as cosponsor
