The reason RoC comes into play is because the government will issue a conditional green card if you've been married for less than two years and apply for AoS. Had you been married for 5 (or even 2 years and 1 day), you would have obtained a 10 year GC and wouldn't need to go through RoC. It's a balance check to make sure the marriage is not fraudulent. While the processing times are getting extremely slow, everything is based on when you file your paperwork.

So, yes, pretty standard answer, however I asked specifically about “Will I receive the biometrics or uscis will use the previous ones”...

 

ok, will continue to wait and do nothing...

So I had put in a service request as well but I got a different reply. I got a letter from my local office saying that my case was still in California Service Center so they couldn't do anything. It basically said, keep waiting.

I was told this recently. I had the world's worst officer for my interview on September 10 2017. I had already been told before this interview that my paperwork had been "mishandled" (short for lost) This woman was rude and accusatory. She said nothing to my husband. After 2 hours going through my paperwork, she told me my vaccinations had expired. ( after we got home I realized that she had not bothered to put back my birth certificate.-I was told when I called that they had no way of "finding it" and I would have to apply for a new one)  Not my vaccination papers but my 'shots'. She said I would have to have them again. Said I would be getting more paperwork in the mail. My vaccinations DID NOT expire. I ended up calling the highest office that I could 2 days later. I got an email stating, that day, that I had a new officer for my case. The next day I got an email telling me that my GC was on its way. I wish now that I had waited until October 3rd to complain as that would have been 2 years we were married and I would have received the 10 year! As it is now, my application for 10 year is in LIN and from the spreadsheet, most there for this skip biometrics for the most part and majority skip interview. So, I am waiting the apparent 10 months that this service center is taking.

Hello everyone, 

We are the family whose I-797 was returned to USCIS for being deemed "undeliverable". That was on August 14th. 

 

We still haven't received it, and it is now beyond 30 days. We Will be calling tomorrow to ask for more info as they wouldn't tell us anything on previous calls since 30 days had not yet passed. 

 

I have two questions...during the I-130 process, I, the petitioner, could get info on my husband's behalf. Now they refuse to speak to me. Is it possible to register me as his agent over the phone so in future calls i can speak for him? 

 

What happens if you don't get the I-797 before the green card expires???

I'm not sure why you can't get the information but in ROC your husband is the petitioner and beneficiary, so maybe it's because of sensitive information or whatever since your name isn't really in the application (as it was in AOS process)

If you are getting very close to the green card expiration and you don't have the extension letter, you could go to your local office and get a stamp that acts as a green card but I understand the stamps invalidates the letter and is only valid for 12 months (extension letter is valid for 18).

For anyone with the Texas Service Center (SRC) we got a notice dated 9/11/2019 they are reusing my husband's previous bio-metrics. So, updated timeline:

 

7/17: ROC filed

7/22: Received  I-797/extension letter dated 7/19/2019

8/27: Called USCIS to request action for bio-metrics appointment

9/18: Received notice from USCIS they are reusing husband's bio-metrics dated 9/11/2019

Did they tell you this when you called? My case was sent to Nebraska from Texas on July 29th. It seems, from the spreadsheet that the majority of cases do not have either an interview or biometrics. It also seems that it takes about 9 months to hear anything. I don't really care at this point, but I am just curious to know if you were informed by phone as well as by mail that you would not require a second biometrics.

No, we called to ask them to put in a request/ticket to find out why no biometrics and they told us to wait 30 days until calling again. I got the notice in the mail today.

Hi ! I sent my package july 13th  . But the Notice of action receipt was sent back to USCIS Because post office couldn’t deliver it . I called and updated my address   And they sent me a letter that they got my request.. but since then i haven’t heard from them nor has my online status changed.. the only thing am worried about now is that my GC expires on October 12th . And i probably won’t be working...i also want to travel in December . I really hope they give me a reply before December.. My question is will be able to work even when my GC is expired? Please any information is appreciated!
