I am going to fill out a I-864 in 2006. I filed my taxes for 2005 in March. Do I have to enclose the tax transcripts or W-2 for my taxes for 2005 in the I-864. I am asking this because I already got the file notarized and it says that my income is 125% of poverty level and I filledout the year dollar amount of poverty level based on 2005 and not the 2006 guidelines..Is that ok or do I have to change the form?

NOTE: 8 CFR 213 states that consular posts will begin to use updated

guidelines on the first day of the second month after the date the guidelines

are published in the Federal Register. Consequently, the 2006 guidelines are

effective March 1, 2006 for visa processing purposes.

2006 Poverty Guidelines

From the above they will be using 2006. On looking at your timeline you are still at service center??? I would complete a new I-864 to reflect the 2006 poverty guidelines when it comes time for the interview.
