US Visa Interview with a 221G Administrative Processing Result

Now I still login on CEAC to “immigrant”, but the title shows “nonimmigrant visa application” and the status shows “application received”. Case created 7/2/19.

I was in AP for about 2 weeks:

 

My interview date: 6/14/19

- AP 6/14/19 (and 221g)

- Ready 6/26/19

- Ready 7/1/19

- application received 7/2/19

Well, let’s see that it’s headed where I’m hoping it’s headed... especially considering that in the interview they asked me about the circumstances in which I was denied of a B-2 visa...

That was fast ! 

No I'm actually optimistic, I emailed them 3 times no answer, called Em few times and same answer it's processing and we can't view the Consular files so you have to wait until they contact you.asked if they needed anything they said if they did they would have asked after interview or contacted me so I'll just wait for now and hopefully soon for all of us.

In fact, they are obligated to take the approved petition as prima facie evidence that the beneficiary have met the requirements of the visa classification. It is highly theoretical but the consular officers have zero authority to do anything about an approved petition. 

They do have the authority and often send them back to USCIS for review (3-6mth process) and in many cases are then returned to "State Department" with findings that they stand behind the original approval. It's a crappy tactic they use to delay and pass cases back and forth. I had a K1 221G from India that never resolved after 8mths so we abandoned when medical and everything expired to marry abroad and filled for CR1.

 

@Elizabethlh - Hope for the best and prepare for the worst. I would expect that the US Embassy in Cuba is under silent instruction to not facilitate any immigration based on current political issues. I would bet $ on it but we'll never know and they'd never admit it!! 😢 I would start researching a mutual country that is accessible for both of you and discuss alternatives down the road.

How is your CR-1 process going ?

I’ve read that even if we do CR-1 we will still fall under AP because of this current one ... I don’t know if that’s true.

Thank you . Actually a lot of Cubans are approved under K-1 and Cr-1. We met about 7 couples that had the interview same week as us and all were approved. We were the only ones sent to AP.  But yes! I’m hoping for the best and also seeing other options. I’m not waiting 8 months

And today I’m back to AP, but this time under non immigrant. 

 

CEAC message: “Your visa case is currently undergoing necessary administrative processing, which can take several weeks. Please follow any instructions provided by the consular officer at the time of your interview. If we require further information, we will contact you. If your visa application was approved, it will be processed and returned to you by courier within one week.”

It's going well. We sent email to NVC/USCIS in October 2018 to close our K1 case (didn't wait for a reply but one came 60-days later confirming case closure). We re-filed in Jan 2019 (married Nov 24th in India) and had NOA2 on April 30th. NVC docs uploaded June 15th and waiting for docs to be qualified for appt scheduling.

 

Just to clarify, you very well may receive approval in the coming weeks or a few months time from your AP status. We chose Plan B ONLY after all medical had expired at 6mths and instead of repeating that expense again on K1 we opted to move ahead with marriage and CR1. This way he receives AOS as part of the process and we don't have to go through more fees and adjustment once he's here.

 

I would research other cases from Cuba to see if there is a trend of denials or AP because of political sanctions or others who are receiving approval after AP through that embassy.

 

It's a REALLY hard decision and not easy to redo everything so please I urge you to research and hold until you are comfortable and believe you will not see approval. I hope and pray that you receive quick resolution and do not have to adjust to a Plan B!! 😁

They make it so confusing . Now, What does that mean ? 

Do they have your passport.?

That's good to hear!! We felt the same way watching all our friends and others get approvals and we were placed in AP at interview. It was heartbreaking...

 

It sounds like you'll see resolution in just a few weeks/months from other cases and I'll be cheering you on!!

Yes it’s been hard for both of us to see everyone get approved and leaving with their SO. But I am ver happy for all of them. 

I pray that our case won’t take long .
