We just got an RFE requesting a Divorce/Death Decree for both my fiancee and I. Neither of us has ever been married before. Is this right? Was this something that should have been included in the I-129F? Thanks everyone! :help:

Wow, there was a line requesting that specific information on the form I129-F.....You checked the "No" box.

Send a letter, stating no previous marriages prior, with a notary stamp, via FEDEX. Indicate the case number on the outisde of the envelope, in red ink. ATTN:RFE

It helped our case, it may help you. (as an aside, we got our NOA-2, within 2 days of the FEDEX return response).

Do you want a quick fix? Do it as above, to be sure.

No, it is not something you should have included. How would you include something that doesn't exist?

Follow the instructions for mailing on the RFE and do as already suggested. Write a letter and have it notarized, saying neither of you has been married before. Then for your peace of mind and understanding, I suggest you look at the copies you kept of your I-129F and the G325a's and determine whether you left blank instead of writing "none" in the spaces on those forms that ask about former spouses.

If you left them blank, you'll learn something. If you did it right, you'll have yet another example of other peoples' mistakes.

Facts are cheap...knowing how to use them is precious...

We both checked "single" on the I129F instead of divorced, widowed, or married and left the Names of Prior Spouses blank, but wrote "none" under the space naming former husbands or wives on the G325A.

Wow, I can't believe we got an RFE for that. Live and learn I guess. Thanks for the advice!

An update on this:

We sent a covering letter, the original RFE document and notarized statement of no prior marriages by Fedex to the USCIS California centre. The envelope had our case number and "Response to RFE" in nice big letters on it. It arrived the next day (5th June) and we were hopeful that our case would be touched within a few days.

It's now the 18th of June and still no response. We called the USCIS after a few days and asked if they'd received our package, but they suggested we call back in another week due to 'computer problems'. A week later we called back and we were told to call back in another week due to computer problems. Frustrated, we sent another package to them, this time by standard mail, again with the case number in big red letters on the envelope.

We've still not been touched, have no idea if they've even received our response and are getting nowhere with the operators. Is this normal? Does anyone have similar experience?

Thanks,

A & C
