K-1/K-2 Documents required? Mexico

Hi everyone,

 

If anyone could please advise me on what is required for the minors in mexico. My fiancee(k1) has 2 kids at 7 and 9. She is nervous about needing consent from the father of her kids, who is not in their lives at all. Would we need a passport for the kids? consent from the father? anything needed from the father? Please if anyone knows or has experienced the process.

 

I only know what I've read from the mx/us embassy website. It says minors can travel without documents as long as they are with 1 parent. But does this apply to the visa process?

 

Any information would help. Thank you

We did a K1 Visa with a K2 for my minor daughter.  

A passport will be required for the child to enter the US. The children are each given their own visa (K2) 

As far as consent, I struggled to find an answer as well and eventually managed to get a consent letter from the absent father. I did not see it listed as a requirement and I don't think it is necessary when you apply for the K1 and K2 visas or for any of the USCIS process. I am not sure what the circumstances and conditions are in that regard when your fiance leaves her own country with the children though so it may be worth trying to find out the rules there.

Yes. i did read that things vary from each country. Now that i think about it. If you don't mind, could you please briefly explain how the consent from the father of your daughter was made? Was it a simple written letter at home with both of you singing or does it require a lawyer/notary etc?

It was a fairly simple letter, but he did have it done before a notary.  I have no idea if that was required. Actually, I had the hardest time finding any consistent information on what was required.  

In my circumstances, and this may vary by country, the fact that I had sole custody apparently helped and I was told by some that I didn't need the letter on that basis and by others that it was a good idea to get it. I was never asked for it by any US officials at any stage of the process, but I did submit a copy of it with the original K1 petition my husband filed.  

The letter was brief and stated something along the lines of I (insert full name of the father) confirm that I consent to my ex wife (inserted my full name and date of birth) relocating with my daughter (insert full name and date of birth) to the USA.  

He also attached a copy of his government issued ID which was also stamped and signed by the notary.  

Again, this may have been way more than I ever needed, if I even needed it at all, but I didn't want to get to the POE after the whole process and then have a problem.

First check the US Embassy for Mexico.  Next seek out a sub-forum for Mexico.  Go up to the blue ribbon and select forums. Scroll 3/4 of the way down the page and find your subforum.  That's the best place to ask. This maybe needed at immigration when you leave and not necessarily for POE.
