I 751 RFE...can I apply for N400?

Timeline

Hi, I applied for I 751 in January 2018 and received 18 month extension letter. In April 2019, I received RFE and I have until this Friday (June 28) to send them all the evidence.

 

My question is, can I still apply for N400 or should I just send them all the required evidence for I751 and wait for them to send me a green card and then apply for N400? 

 

I didn’t apply for N400 before because I was traveling in and out of the country a lot. I have been married for 3 and a half years now. 

 

What’s the correct route in my case? Please help!

02/02/2015 - NOA1 received, Nebraska Service Center

07/13/2015 - I-130 approved!!

07/20/2015 - USCIS sent case to NVC

07/24/2015 - NVC received

08/10/2015 - Case number assigned

08/13/2015 - Submitted DS-261

08/15/2015 - Paid AOS fee

09/01/2015 - Sent IV and AOS package

09/03/2015 - Scan date

09/09/2015 - Got DS-261 reviewed on call

09/10/2015 - IV bill available and paid the same day (currently "In Process")

09/11/2015 - IV bill status changed to "Paid"

09/15/2015 - Submitted DS - 260

09/28/2015 - Case Complete!!!

10/02/2015 - Received interview letter (P4) via e-mail (Interview date --- November 05, 2015)

Embassy

10/06/2015 - Medical done!

10/13/2015 - Received medical report

11/05/2015 - Interview (APPROVED!!!)

I suggest responding to RFE first, and then you can file N-400. Just my 2 cents.

06/13/17 -- Interview [7:30 AM at Mumbai, India]. Visa Approved

06/15/17 -- Visa in hand

06/21/17 -- POE at DFW (Dallas, Texas)

----- Removal of Condition -----

Removal of Condition (I-751) [Approved]

06/18/2019 -- Sent the package (3 Days before GC expires, cutting it close). Sent to Lewisville, TX via FedEx Ground

06/19/2019 -- Package received at around 9:30 AM (Hoping I don't get rejected for missing deadline)

06/24/2019 -- Card was charged with $680 fees. Text Message received confirming Receipt. Case routed to NBC (Case Number starts with 'MSC')

06/28/2019 -- NOA Hard Copy & 18 Months Extension Letter Received in Mail with NOA Date as 06/19/2019

07/12/2019 -- Biomentrics Appointment Letter received. The Letter is Dated 7/5/2019. Appointment is on 7/22/2019

07/22/2019 -- Biometrics Appointment Complete

02/01/2022 -- Interview Scheduled for 3/3/2022 (combo interview)

03/03/2022 -- Interview Complete. No new Green Card will be produced as my Naturalization was also approved.

03/04/2022 -- USCIS status changed to approved.

03/26/2022 -- N-400 online application complete. NOA Date.

Do you mean you are wondering if applying for N-400 will slow down processing for your I-751?

If so, I-751 processing will not be affected in any way.

If not, please elaborate on your question. I am afraid I don't understand your concern.

N400 is like volunteering to USCIS another brand new vein in your arm ... (pardon the metaphor) 

N400 is a brand new process which gets initiated in parallel to whatever else going on with other forms. 

 

Now, once they get your I751-RFE, will they bundle your i-751 along with your N400? or will they process your rfe and approve i751 right away? I think there is no settled opinion among the luminaries of this board about that situation. 

 

RFEs do get processed (somewhat) within six to eight weeks time-frame. Injecting N400 into the mix would create uncertainty on that timeline.

Yes that’s what I meant. I’m sorry I didn’t make myself clear. 

 

I was reading in another post that some people found that their cases were delayed when they applied for N400 with I 751 pending so just wanted to be sure.

 

When I apply for N400, do I need to mention that I have applied for I 751 as well?

Filing N400 is a choice. You can wait until your approval comes thru on your ROC and 10-yr green card is in hand before filing N400...or you can file it when your 90-day window opens up and while your ROC is pending. Either way, the progress on your case depends on timely responses to RFEs (which you have yet to reply to) and if the case officer decides to adjudicate both applications and grant you one interview for both cases.

If you are filing online, you have to upload a copy of the front and back of your green card. If filing by mail, you have to photocopy the front and back of the green card and send it with your N400 mailing packet.

The only green card you would have in your possession is the conditional one so that alone will let them know you have filed petition to remove conditions with a simple search of your name and DOB on their database.

@fatimanazir92, as @kline19 meticulously stated, there is no right way to answer that. It never hurts to apply, but if you are willing to wait out the processing of your I-751, you can always wait for that process to complete. There is no maximum time-limit on when you can apply for Citizenship anyway.
