Here is our situation.

My fiance arrived to JFK airport with a K-1 visa on Feb 17, 2007 and got an I-94 stamped with "Employment Authorized" until May 16, 2007.

On Feb 27, we were legally married.

On March 26 our I-765 Application for EAD was recieved by USCIS.

On April 19, we went for the Biometrics interview to get fingerprinted.

We recieved a Social Card with the married name change that says "Valid for work only with DHS Authorization".

On May 16, the Employment Authorized stamp on the I-94 expired.

My question is... Is my wife eligible to work now?

If so, what proof do we have?

12/03/05 - Mailed I-129F to VCS

12/05/05 - I-129F arrived at VCS

12/09/05 - Check Cashed

12/14/05 - NOA1 arrived

12/17/05 - NOA2 arrived

No, she's not. She will have to wait until either her I-765 is approved or her Green Card Arrives.

K1 Visa holders are only authorized to work for 90 days after entry into the U.S. (the duration of the Visa).
