NOIR assistance please...

Timeline

Hello... my husband and I have received the NOIR for his CR-1 visa. I was wondering... does anyone have a redacted sample of an NOIR that I could take a look at to determine how to go about creating this document? I have researched quite a bit and found many other documents such as "waivers, etc..." but nothing that speaks to what the NOIR should look like and no example. I know this may be a lot to ask but I'm just trying to get it right so that I'm not just sending in a random "letter".  There were no instructions other than prove your relationship is bonafide in your response. LOL>

A NOIR will list why they intend to revoke the petition (i.e. not a bona fide marriage) and the reasons they believe so. You will need to respond to each point and provide documentation as available. Include a cover letter describing what is enclosed in the response.

 

Somebody else's NOIR won't help you...the reasons will be specific to your circumstances and case.

Exactly. Someone elses list of why they were denied will not help. Just look at each point and start getting your evidence together.

Your time to respond to a NOIR is limited / usually 30 days so gather your proofs to dispute each issue

time spent finding out what we can tell you is wasted time as none of us are witnesses to your relationship and what has happened and what the embassy has a problem with

this is up to you to prove your points and disprove their's 

this is not meant to be harsh but meant to make you move fast to answer the NOIR

the # of days to answer can be 30 or 30 business or 60 but still any of those goes by too quickly

Good thing you already know what they want "prove your relationship is bonafide" so imo you gather all documents and stuffs which can help convince them that your marriage/relationship is bonafide. More pictures,chats,call logs,if any kids the birth certificate (s), if you changed name and took your husband's, any document to prove that may help, maybe add him to your lease too if possible and also some bills (my wife added mine even with me not being around), if you have a life insurance with him as beneficiary (you can still get one now), your work documents showing him as emergency contact etc there are many documents you can gather which will help your case to be reaffirmed, just take a deep breathe and start working on the evidences. Good luck.

Thank you. Yes I know there are specific points. I’m not needing the subject matter of someone else’s NOIR. I was just asking for an example for context.

I’ve already begun the process of responding. I just wasn’t sure as to what needed to be included in terms of format. I don’t believe it is a waste of time to seek clarity from others who have experienced this. Isn’t that what Visa Journey is about? Helping and supporting others who are going through the process? I was encouraged to post and ask my peers for help in this forum. That’s all... was just seeing if there was an example in terms of formatting.

I totally understand. Possibly the responses are base on others thinking you want to know what their responses were, rather than the actual arrangement of the letter, how to use the proper verbiage and how to assemble the rebuttal.  I have not prepared one and agree that there are limited resources on the actual assembly here or on the web, I looked around a bit.

Do you mean the rebuttal?   As other have stated it is case specific.   Organization is key.   The NOIR has listed  points from the counselors notes.  I listed our rebuttal in the same order beginning each number with the point in the NOIR and finishing with our response and/or listing evidence.   I compiled my evidence behind the rebuttal and numbered them to make it easier to match them up.

Yes, that is accurate. Obviously I wasn’t as clear in my request as I wanted to be... but, you live and you learn. Thank you for even confirming in regards to resources. I appreciate it!

my above reply was too abrupt and i just spent over an hour searching the internet every which way possible with questions like "how do i write a letter to respond to a NOIR?"

every site took me to an attorney that explained what a NOIR was

 

the very best thing i read is the following:

 

The Consular Officer explains the negative information in writing and sends the file back to the United States. USCIS evaluates those concerns and will then issue a Notice of Intent to Revoke (NOIR). The NOIR details the problems encountered at the visa interview – maybe there was conflicting information or the foreign national doesn’t know enough about the U.S. citizen.

Typically, you have 30 days to respond to the NOIR. You have to show USCIS why your I-130 petition should stay approved and why the Consular Officer made the wrong decision. If you’re successful, the case will be sent back to the U.S. Embassy or Consulate and a second visa interview will be arranged.

 

it goes on to say 

you have only 30 days and that means USCIS must receive the letter and proofs within 30 days (not a day longer)

and that this is your only chance to submit proofs of the relationship that USCIS will not look at anything mailed after the 30 days (or in separate letters)

 

I had a NOID not NOIR so i wrote a good brief and i numbered the 2 issues (did not know what books i  read and would make me convert to Islam)

then i outlined my answers and sent rebuttal with proofs sending  in emails dated years before that interview showing he did not request me to convert and that we talked about the difference in literature (even explaining the word literature) between the 2 countries 

 

I find that emails prove a lot more than chats as the date of the email is easily seen

You may be LOL-ing now, but immigration is no laughing matter.

They have already 'told' you what they require and you are aware: prove your relationship is bonafide in your response

Can you not write a letter proving your relationship is true and genuine? 😕

You're welcome!   I also recommend that in any letter that also poses as a sworn statement you add the under penalty and perjury statement.  

 

"I declare under penalty and perjury that all the above is true and correct."
