Wow...We're nearing the end of June 2019.....that is crazy!

Sounds like they sent your packet to the place where all other packets are sent to die....the USCIS Black Hole! (I'm sorry, I'm being facetious!)

Have you mentioned to the officer that the case was sent in since Oct 2017?

Yesi did, when you send case inquiry,  you need to tell them when you did file.

So they know everything,  it's weird because they send it to storage after receiving my response to the RFE!!

I started to think that some RFE are sent randomly without even looking at the cases.

Do you live in a district repped by a Democrat? Maybe John Lewis? Definitely contact their staff (even if your rep. is Republican) and tell them all these shenanigans and ask for their help.

If you don’t have a lawyer, you need to get one.  They can file a petition to have it processed. However you can also contact your Congressman or go through the Ombudsman office.

The Ombudsman's Office was created by Congress in the Homeland Security Act of 2002 to help individuals and employers who need to resolve a problem with U.S. Citizenship and Immigration Services (USCIS) and to make recommendations to fix systemic problems and improve the quality of services provided by USCIS.

It's far too soon to look at filing a WoM. They got an RFE 90 days ago...no reasonable judge is going to order them to make a decision in that timeframe. No need to lawyer up yet.

This is especially the case as they claim to be retrieving the case from storage and intend to review it.

It’s not the RFE I was actually referring to.  I still would get a lawyer.  And I would still do the other steps.  Sending the paperwork to the dead files to me signals there’s an issue aside from the RFE.  Granted it could be just a clerical error but the Congressman option costs nothing and would encourage the USCIS to work perhaps a little faster.

Nothing wrong with reaching out to a congressperson. There's nothing really for them to do at this point at least until the 60 days are up, though.

Getting a lawyer is never a bad thing to do, although I still don't see what benefit they could possibly provide at this time. Like...you hire them on retainer and then...?

I’m not an attorney, so it’s difficult for me to say if they have anything up their sleeves that we haven’t thought of.  I’ve read other posts that Congressmen were able to push things through even after denials.  Course, I’ve read others that have said it was a waste of time.  So, if you don’t try, you never know.

I'm not one either, but there's nothing to do but wait at this time. USCIS responds to inquiries from an attorney the same as they do if you contact them directly.

Now if the case was denied, then there would be a stronger cause for an attorney, depending on the reason for denial. Challenging a denial is a longer and more complex process. But there's no indication that a denial is likely here...it's just waiting followed by more waiting.

A congressperson cannot "push anything through" nor impact a denial. They can request an inquiry on one's behalf. That may or may not "nudge" somebody to look at the case if it's been lost in the massive paperwork they have there. Although I don't think that really applies here either as they identified the location of the petition and stated that they will review it. They need to be given the opportunity to do so (they stated 60 days, but I wouldn't be optimistic) before there is any reasonable expectation of getting any new information.

Yes, stay in contact. Make inquiries. Do it via a congressperson if you desire. But they responded to the latest request and stated 60 days so I wouldn't expect any new inquiry to provide anything else at this time.

I don’t agree with you but everyone has a right to their opinion.

I hired an attorney to make sure I didn’t have problems.  They know the law far better than you or me.  At least the good ones do.  I know there are people that don’t hire attorneys and do just fine...but I didn’t want that stress.  The original poster got a RFE which can happen to any of us...but then undeniably there were other problems which may have been preventable.  I can’t help but think that if they had an attorney, they wouldn’t be going through this stress.  To each his own.  There’s no right or wrong answer here, just differences of opinion.

I would also disagree. I've been on this site way too long and too much to see that attorneys don't prevent RFEs. Sometimes they catch things. Sometimes they cause things. Either way, not an issue for the OP.
