Can I enter the US using the Temporary I-551 on an expired passport?

Hi guys,

 

I hope someone can help me. I know this is a silly question but here I am. I recently entered the US as an LPR and got the stamp on my Temporary I-551 which has a 1-year validity after endorsement which is on my Philippine passport.  Then I went back to Canada 2 weeks ago for a visit using the Canadian permanent resident card. I currently still haven't received the plastic green card. The problem is I just noticed that my passport just expired! Will I be able to drive across the US border by just showing the stamped temporary I-551 on my expired passport?

Well you can certainly try, but it's pretty risky.

You need a valid passport to enter the US. Even if say you had your green card, you would need a valid passport and your green card, having just the I-551 or green card is not enough.

I don't think the I-551 may be enough unless they just happen to not notice that the passport is expired.

Last time we entered the US, the CBP officer asked for my wife's passport after she presented her GC........for what it's worth......

Well the OP doesn't have a choice considering the stamp is in the passport

The last time I entered with my ex, we handed both at the same time.   CBP asked if she was entering on th GC or passport.   She said GC.  He handed her passport back

Well, as I recall, my wife was sent to a special line...and some special mark was made on her machine paper slip (I don't know the name).......might have been a random security check or something..

They can ask an LPR for it, but you're not obligated to provide it. 

 

The only thing they absolutely can require you provide is your green card, or equivalent (expired green card + I-751 NoA, etc.).

Oh thank you. I guess the temporary I-551 on my expired passport is just fine as a proof of LPR  and for re-entry purposes. I hope the plastic card comes soon.

Can't you go to the Filipino embassy in Canada and get a new passport?  Then you can show both the expired passport with the I-551 and the new valid passport at POE if asked for it. You'll need a new passport anyway, why not use this as an opportunity to get one?  At some embassies abroad it is much faster in situations like yours.

I need to start working soon and it will take one month to renew it.
