Hey,

 

We are trying to calm our nerves for our upcoming interview.  And we both asked ourselves something we haven’t thought about before.

 

What happens if they deny your application during the interview? We don’t think ours will, but I guess we’re just planning the best we can.  If it’s denied, we will both be able to walk out together and figure out an appeal or the next steps - or will I for example, be arrested or similar if denied? (These last minutes nerves are obviously taken a toll on us as we haven’t even played thought to this before.

 

And for anyone who was out of status when they interviewed.  After being asked if you had ever worked out of status or overstayed a visa - and you answered yes - did they ask you many further questions? How deep did they dive on these two questions? Or did they just accept your answer of yes and moved on?

My understanding is that if you are denied at the interview, you will be allowed to leave together. Not sure what happens after that, but I believe they issue you a paper which states why you have been denied and what next steps you can take. My first stop would be to an attorney. The only people who I have read about being detained during/after an interview were those that already had deportation orders in place, and where ICE coordinated with USCIS to pick up the immigrant.

 

During my interview, when asked if I had ever violated the terms of my visa, I answered no. The IO reminded me that my I-94 had expired a couple of days prior to my applications being received, so I had actually overstayed. I agreed, and it was never mentioned again. I was approved at the interview.
