I sent the I-130 for my 17 years old son back in April this year, I need help to figure out if I can apply for a K3 visa so he can wait here and attend school while his visa is processed. (He has a 10 years tourist visa). His mother had another baby like a year ago and the baby is sick and need a lot of attention and that is creating an issue for them!!.

If he is in the US have you considered Adjusting his status?

The two options is the B2 visa he has, which he can only be in the US 180 days a year, and the I-130 you filed for him. 

Are you a US Citizen?  If so  you can AOS him now, but he can't go back to mom until he gets his AP or GC.   

 

He can not be a student on a B2 visa.

No such restriction exists. The period of authorized stay is determined at entry, often 6 months.
