My fiancé and I filed the I129F together from New Zealand (she was on a working holiday, I’m a kiwi). We put together the application, made sure everything was filled out correctly and checked it ten times before sending it away... Received the NOA1 dated 03/04/2019

 

 

we recieved a new transfer notice with the date of 06/05/2019 recently from the Cali service centre telling us that...

“we have recieved the appeal, motion or certification for the petition listed above. We have forwarded your appeal to the USCIS admin appeals office listed below for processing. The AAO will notify you in writing when they make a decision on your appeal or if they need additional information.” Goes on to list the address of the appeals office in Washington DC 

 

An appeal was never made, this was the first letter recieved since the NOA1. Why would it go to the appeals office? Can anyone shed some light onto this for me? Has anyone been in this situation?

You can give them a call about it or just ignore it.

 

I got the same update on my ROC, about the appeal that I never made. USCIS notification system is known for being messed up.

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

I agree with Roel, sounds like a clerical error.  You can call USCIS to confirm.

Thanks for the replies 

 

An update for anyone who has the same issue...

 

After calling USCIS they told us the petition had been sent to the appeals office by mistake and they had sent it back to California for processing.  Fingers crossed the NOA2 isn’t too far away now. I hope this isn’t a big set back
