If your i-94 is not expired or is not within 2 week of its expiration. Then yes, you can apply for one. But note it will not have authorization for work, it will be useful only for DL (depending on the state) or adding yourself (assuming you're the immigrant) to your partners accounts.

I’m on a K1 visa and my I-94 has expired already. We got married already and now applying for AOS and for SS card

You will need either an EAD or green card now.

There is a box to check on one of the forms to automatically apply for a SSN card when applying for AOS and EAD/AP.  

 

From SSA:

 

"To save you a trip to the Social Security Office you can now apply for your SSN and card (SSN card) on the same application form you will use to apply for permission to work legally in the United States (U.S.). That application is the Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services (USCIS) Form I-765, Application for Employment Authorization. If USCIS approves your application to work in the U.S. and you completed the section on the application to request an SSN card, then USCIS will send SSA the data we need to issue your SSN card. If you already have an SSN and you requested an SSN card on the I-765 application, we will issue you a replacement SSN card."

@Yetzky - I have bad news for you. Welcome to so-called limbo. You won't be able to get SSN until you receive your EAD (4 - 9+ months) if your I-94 is already expired. I am in similar situation, applied for AOS in February, went to SSA office with VALID I-94 (for another 5 weeks) and their validation + validation with DHS took so long that my I-94 got invalid. I tried everything and they just kept sending me from SSA to DHS and back. The only way to apply for SSN is either having a valid I-94 or EAD. Good luck and strong nerves. 

 

If you're lucky finding a job you can apply for an expedite of your EAD. I did that too, and my expedite is being ignored since May 1st. Lost the potential job.

True, when filing for EAD, you can also apply for SSN  thru it by checking the corresponding section in i765 form.

 

Once your EAD is approved,you will get the EAD from USCIS and SS Card from SSA offcie without visiting SSA office.

Yeah, I came on K1,  waiting for AOS to happen since mid February. Timeline showed early June, now jumped to late August / mid September. Curious what's coming next. I'm still without SSN, driver's license, US bank account or any official document, fun.

Bummer, I might have the same fate as you are. But let’s keep our fingers crossed. Btw, were did you send your AOS application? Is it just one address?
