Which is better to file a K1 or a K3

As tempting as the K1 might seem right now (because you want to be together as soon as possible, I get it 😉), the biggest disadvantage is the fact that after you guys get married, your then husband will not be able to work or travel for months and months while in the AOS stage..

Unless your then husband has enough savings to keep him going for those months, he will be fully financially dependent of you and I’m not sure if that is the best way to start off a marriage as it is not really a situation of equal partnership. While you are at work all day, your husband will not be able to do anything and this can cause frustration, home sickness and trouble right at the start of your life together.

 

So I would suggest the CR1 route, because it gives the both of you a fair and equal start of a life together.

One other thing to know is that if you go thru the K1 and it is denied it can not be appealed if refused at the interview.  You lose the time and money.   A spousal visa can be "reaffirmed" which is essentially appealed.

 

Make sure you meet the financial requirements of I-864P so there aren't any surprises.

Oh wow thanks for that information i thought there was a way to appeal it does that mean we couldn't try again ? and when i use the calculator the minimum was 16,910 for me and my fiance it would just be him no kids and i make well over that i should be find correct ?

You need to make 125% of the federal poverty level for 2 people.

I’ve read so many posts here of people having relationship/financial struggles once their fiancé is here, they get married and then the new spouse must stay home alone all day while the other goes to work. Some relationships ended because of this.  

 

With a CR1 you can drive , study and work right away.

 

other visas have been abandoned because a family emergency came up back home before AOS could be completed and they couldn’t get Advance Parole in time.

 

I personally think the K1 is the cruelest visa out there.  Too many restrictions.  No matter how anxious you are to see your significant other, it’s worth the wait.

Thank you for your response this is a great way to look at it i didn't think about that it is unfortunate that my fiance would be home and unable to work do you know the processing time currently for CR1?

I don’t know if things have changed much since we filed in October 2016.  We were approved on August 1,2017.   I last heard K1s were taking about 8 months, so you’re saving 2-4 months maybe.  Not a lot of difference considering the fees and waiting time for a green card.

My husband and I just finished the CR-1 process and it took 11 months from filing the petition to visa approval.  It does vary somewhat based on the embassy/consulate abroad where the interview will be conducted because some countries have a big backlog vs others.  So do some research here on VJ regarding your specific country and fill out your timeline for better advice.  Good luck!

My CR1 will be 10 months. We filed September 2018 and I will have my interview July 30.

It varies per country.

Mary was the queen of her volleyball group.   Everyone else was K1 and they were bored at home, couldn't work, couldn't drive.  It was funny when I would pick her up sometimes, because she played by one of our data centers, to see all the husbands picking up their K1 wives.    She could travel right away, actually did 5 days after entering the US, go to school for nursing, get a job and drive, shop and have a normal life.

This is great to know with all the wonderful information i am being given the CR1 seems better but the Cuban embassy for us is in Washington i would have to get papers over to them wouldn't I?

That makes sense i am leaning towards the CR1 now that i have received great advice thank you
