Hi all, just needed some clarification on a few questions on the I-130 &  I-130A form on a CR-1/IR-1 Visa. I hope you can help me out, here they are:

 

1. For both the I-130 and I-130A I know the instructions say to put N/A if the question doesn't apply to me, but will I really put N/A for every single blank space that is not applicable to me? On the "example forms" on this website there is no N/A written in any of the blanks that they didn't fill out. 

 

2. For Part 2 on the I-130 for item number 11 it  will ask if the mailing address is same as physical address. If you put "Yes" then it won't let you type anything in for items 12.a to 13.b. That means I cannot do any "from" and "to" date for 13.a & 13.b. for my current address unless I physically write it in with a pen. On the example form it does have something in the date field but I'm just wondering if it's needed or not. Kind of confusing.

 

3. I am not sure what to put for Part 4, item number 61.a and 62.a for I-130. My spouse currently lives in the Philippines and we will be over 2 years married before the visa is approved. I am assuming I only fill in 62.a - 62.c? 

 

4. For both the I-130 & I-130A do I need to print and mail also the blank pages I won't use for the interpreters and preparers?

I would just put N/A on the main row and leave the sub-rows blank.

The form clearly says you would fill 12a to 13b only if you check “No” on 11. Don’t try to do something the form isn’t asking for.

Correct. N/A for 61a

They are not blank, put N/A if applicable. Yes you need to mail those pages too. How would USCIS know whether there was no preparer/interpreter or whether there were and pages got lost...

Another question regarding the I-130 form. Part 2, Item 10.a does ask for a "In Care of Name" and on the example forms it's blank. Would that be my name as the petitioner or referring to another person? Thanks.

The in care of name is used when some other person is the primary resident at the address.  In most cases, it is left blank.

Hey guys, another question for you:

 

I just wanted to confirm if I will send originals or copies in for my petition? There seems to be different instructions for this depending on where I look. 

 

So for example, on my birth certificate, will I be sending my original or a photocopy of it? I read somewhere that the supporting evidence can only be copies.

Yes, if you go to the USCIS website it seems to say this, but not on visajourney. Whenever there seems to be conflicting or missing info I always like to confirm. Thank you!

You don't send any original evidence with an I-130 petition, unless specifically asked to do so.  Birth certificate simply requires a copy of the front and back.

 

Follow the guide here on Visajourney which has a handy checklist, or the USCIS checklist that is on the same page you download the form.

Ok, I think the part I got confused on is where it asked for original forms with original signatures, but I assume by those it means the I-130 and I-130A? Here is the quote from the instructions:

 

"Make TWO copies of the entire package before you send it in. This includes the money orders too. You want to have a perfect replica of the package you are sending in. All Forms that you submit must be originals with original signatures. Supporting Evidence that you submit may be photocopies. Retain ALL original supporting Evidence since the USCIS has the right to check them by issuing an RFE (Request For Evidence). If you receive an RFE, follow the direction exactly, and make two copies of what you sent back. During any future interviews the USCIS may also want to examine the original supporting evidence."

 

The text highlighted in red, that means only the I-130 forms right? Thanks!

VJ is out of date.  USCIS official website always trumps any other sites because they make the rules

Right, forms should be original.
