EAD card..some advice PlZZZZZ

Timeline

I married my wife here in the States on her fiance visa. Now, we want to apply for EAD. Do I apply for the EAD under the K1 even though we are married now??? Thanks...Stinger

9-21-06: express I-129F to CSC

9-22-06: signed for at CSC

9-25-06: check cashed

9-26-06 NOA1

9-26-06: Touched

9-30-06: NOA1 received

12-14-06: Touched

12-14-06: NOA2 (said approved and mailed on December 13, 2006)

12-16-06: Received hard copy of NOA2 via snail mail

12-25-06: NVC receives petition approval

12-27-06: Forwarded to Embassy

01-06-07 Called Embassy and received interview date of January 19, 2007.

01-19-07 Visa approved (I flew down for interview)

01-23-07 Flew back to Las Vegas

01-27-07 Married

04-12-07 Overnighted AOS

Timeline

You file for EAD as "Adjustment Applicant" either with AOS, or after AOS has been filed.

4. After filing for AOS. If you did not file for your EAD at the same time as filing your AOS packet, you may still apply for an EAD. You will however need proof of having filed for AOS. This is typically in the form of a "notice of action" or physical receipt from the office you filed at stating that they received your AOS packet. You will file as category (c )(9), "adjustment applicant".

Depends - are you applying for EAD before applying for AOS or, as YuAndDan assume, with or after applying for AOS? It makes a difference.

Advice - do it YuAndDan's way, as an adjustment applicant, not as a K1.

Thanks...i figured it out!!!! (after AOS). Just one last question though....do i fill out application with her "new" married name???? Thanks...

Yep, I assumed after AOS due to the OP's signature showing overnighted AOS 4/12.

You use married name if that is what she wants on the card, and is what she will be going by.

You are well past I-129F NOA1 shown on your timeline, please update it, the statistics helps others.
